2 Hard Inquiries from S. finance on same day! Help...

Security Finance pulled 2 hard inquiries on the same day. Both are dated 11-09-09.  I think they are mad because I owe them like $400 so they did this to get my attention.

 

Is there anything I can do about this. There are other issues with them, but I think I have to post them on another discussion forum. My report is like 33 pages long because I kept refinancing with them, but there are like 3-4 of them that should have fallen off due to DOLA being 2001,2002, but they say

Reported-closed-paid. Is there anything I can do?  Thanks in advance.

 

I am starting from the lowest point at 499. Had hardship due to spouse dec., got laid off, all within a yr. But my important thing is to rebuild credit because that's all I will have and with my 2 daughters 6 & 15 got time before they go to college.

They have the right to pull your credit. It's too bad they didn't do it as a soft inquiry.

 

For those that should have fallen off, dispute them as outdated.

While a creditor or a collection agency can pull your credit report, there are some little-known exceptions.

 

If the debt is past your state's statute of limitations and the debt is too old for credit reporting purposes, a CA does not have permissible purpose for a hard inquiry. 

 

Now, I'm sure that someone will come along and say that the FDCPA / FCRA never mentions this distinction between soft and hard inquiries and they'd be right.  However, I have discussed this a multitude of times with the FTC Financial Practices Division for various cases and their opinion is that legislative intent is clear that no action can be taken that would adversly effect your creditworthiness.  This includes placing notice of an account in collections or reduce your credit score by way of a hard inquiry.

 

I would send them a letter informing them and if they refuse to recode or remove the hard inquiry and / or sue them in small claims court, collect $1,000 and take your kids to see a movie.  Smiley Happy
