Re: Berks problem.

It looks like it might be time for the infamous ITS letter to Experian and to Berks,  the derogatory reporting has caused you to be declined for credit.  You have the proof.

Re: Berks problem.

I just did a search...that's the letter I sent to Experian I believe.

All these acronyms...thought it was the MOV but I used this one:
FCRA Section 611(a)(1)(A)clearly states that upon receipt of a dispute Experian is to perform an investigation. Oviously, this did not hold true of my dispute of xx date. On xx date I received notice from Experian that my dispute had been "previously investigated". According to the FCRA, this is not an option.

Because of your blatant disregard for the FCRA, I am demanding that the disputed tradelines be deleted from my credit report. I am guaranteed, by law, that you will report with 100% accuracy and that any account I dispute will be investigated. You have proven that this cannot be done.

You now have 5 days from your receipt of this letter to remove the previously disputed accounts from my credit report. Be advised, that my attorney has in his possession all the letters and supporting documentation regarding this matter. If the accounts in question are not deleted he will file suit in Federal Court.

Of course I changed the words to what I needed.

Re: Berks problem.

Think I solved the Experian fraud alert. After doing some searching...people are reporting fraud alerts for a lot of disputes. they did start rejecting my disputes so I sent them again right after that and that might have triggered it but I was just trying to clean up things that shouldn't be there.

But another place says if you dispute inquiries this can happen to. And I have disputed inquiries because half of them are duplicates or I didn't give these people my social to run my credit.

Ugh...

Re: Berks problem.

My son has the same problem, but with West Asset.  He paid in full a medical collection over a year ago.    This was showing as paid per his April 2007 report with charge off date of April 2005.  He was approved for 2 cards in April.  Now this December he applied with Target, Hooters and Walmart - All declined due to new recent collection.

The only change on his Decembers Experian report indicates reporting changed on the paid collection  to reflect:  Collection Oct 2007,  Status Oct 2007.

I am going to send the same FCRA ITS info.

Re:Fraud alert

You can literally dispute a hundred million times..........and still no fraud alert should be on without your permission.
there is no trigger to fraud alert you have to ask for it..either in writing , on the automated. or indicate that an account was opened fraudulently and that you want fraud alert there is no other way..
credit bureaus...and the people there can only tell you about it they cannot make you put it on or put it on JUST becuase they think you should have it...so even if you said an account is fraudulent........
you still have to ask for the alert to be on the system... so what if an account is opened fraudulent.. if you don't do anything well then nothing will be done....

Re: Berks problem.

Hey Eddit all of my posts have been directly to you regarding your problem.
if you want them to reinvestigate the same charge without evidence they do not have to reinvestigate.
if you want them to reinvestigate with an additional error in their reporting then they are required to do so.
Good luck in your endeavours.. you seem to be going for the kill .......removing that crap...
.......don't wake up the giant
     be diligent as you are...
then write back and give us all of the good news.Smiley Happy

Re: Berks problem.

Never asked for a fraud alert so...

Keep showing them there was no chargeoff in October but they just sit and do nothing. Going to get it gone...somehow.

Re: Berks problem.

Disputing INQ's will get you a FA.
EXP requires (last I knew) a FA to investigate INQ's.

Re: Berks problem.

They require one to investigate inquiries? Hmmmmmmm...
Why do I have a feeling that's not good.

Guess I'll be calling them Monday.
