I am in the same boat as several of you.   I have two charged off Cap 1's that is killing my util.   All of my other cards are below 10%.   I am very close to the time they should come off my report.   One will come off in July and one in January.   Can't wait to see what happens to my scores then.  The one for January though I am really contemplating paying sometime in the summer.   We would like to build a house in the fall and that is my last big hurdle I think.  I do have some medical collections I am working on but I think I can get those taken care of.  So the Cap 1 I'm dying to get rid of.
 
Only Cap 1 is reporting.   On one of the accounts I have received a letter from NCO but nothing aggressive and only a couple of times.   I will probably contact Cap 1 when I am ready to PFD that last one since they are the only ones reporting.  I assume since they still show a balance they must still own it.
 
If anyone has any suggestions please let me know.  I too don't wont to cause more harm than good.Smiley Happy   Good luck to everyone!!

I tried that backdoor # and it turned out to be a CA called Osi , but I guess because of the weekend no one answered and asked to leave a message and one of their paralegals or legal staff would get back to you. No thanks I just hung up since I have'nt DV them yet.

Ralph- What number did you call? I just tried to call the number I used and it said " Thank you for calling Capital One..." the number is 800-258-9319

Ralph, I just tried this number 800-889-9939 and it said Welcome to Capital One. I used the number 800-258-9319 which is Cap One Debt Recovery number. i just tried to call it again and it also said Welcome to Capital One.....

Do you plan to ask for settlement or are you willing/able to pay the entire balance?

I'll second that request. From the sounds if it, it appears as though there are a few of us who have charge-offs with CapitalOne that would like to get them removed somehow. In my case, I have two chargeoff accounts with tradelines saying "Legally settled for less then full amount".

I called the Account Specialist number listed earlier in this thread and got someone who was willing to give me a $500 credit line increase on my remaining good (for almost three years now CapOne cc). She tried transferring me to a higher level with a secret number she can't give out. Unfortunately, the line dropped right after she transferred me and the second party answered.

I called back and got different advice from a different Senior Account Supervisor. She gave me the number for debt recovery and collections that have already been posted.

Let's each keep this thread up to date as we progress. My goal at the moment is just to find the right department.

I called the debt recovery number and they offered me an opportunity to make 6 monthly payment on the entire balance of $737. This amount is listed as a charge off and in good standing/currently pays as agreed on my EQ report which don't really understand why it is a charge off and is in good standing/pay as agreed.

I too have (HAD) a Capital One joint account from 1999 that had a limit of $3000.00 and I checked my credit report this month, the balance is up to $9500.00. This is crazy and Capital One has sold it to an attorney's office in Miami FL that attempted to serve me with legal papers and take me to court to sue me. It did not work! That SOL that shows on my credit report is 07/03 (which is incorrect). I really don't believe that I made any type of transaction during 2003 with Capital One, I think that they are trying to reactivate the last date of payment. I REFUSE to pay them $9500.00. I recently did  a DV letter and I received a letter from EQ that the debt was validated although I really don't believe the DOLS is valid. There is more due on this account than the car accounts for my jeep and expedition together. I most certainly need help or suggestions.

I got a nice little suprise yesterday. 

 

Scorewatch alert of +29 points due to changes on Capital 1. New FICO EQ is 662! Woohoo!!

 

Whaddya know.....just like Modern's, Cap1 has "sold/transferred" my account, so now shows 0 balance, which gave my score the kick.

 

No CA has done an inq yet, so based on what Modern saw on his, I guess NCO will no longer be the one to send me letters!

 

So nice to have the balance out of my utilization, but I am so afraid of what will happen when the CA starts reporting?!?!?!  I would think a new CA acct would be much worse than an old C/O.......am I right?!?!?! 

 

But they did update DOLA (which they've chgd on reporting several times and which was one of the issues I was going to be working with the atty on) .Now shows 8-03, so should definitely come off report  in 2010, as DOFD was 03-03.

 

And the really good thing is I'll have a very good shot of getting CA acct  removed as 'obsolete debt' as GA  SOL  for CC is 4 yrs , unless the CCC  or CA can produce a signed application and wants to take me to court and have a judge decide if it should be w/i SOL as a 'signed contract', which has 6 yr SOL.   There have been a few cases like that in GA, but 4 yrs SOL on CC is usually correct.

 

I'm assuming Cap1 is considering it past SOL since they sold it.  I've read all over this forum that they usually wont sell their accts so that they can sue just prior to SOL, and if that's the case, they'd probably be more that happy to take any offer.  As I've said, morally I want to pay what I owe, but the $1958 they were showing as owed on a debt of $200 (or less---had $200 CL which I didnt exceed with purchases--fees put it over) has seemed really usury.

Still no word from my CA yet either Rom, they pulled TU for me though.  I'm still waiting for a lettre from them everyday when I get the mail.
 
It's HELL.  If I ever accumulate the money to pay it off, I will just to abolish the fear.  At least they're not supposed to put it on your CR until after they've contacted you and given you time to respond *cross fingers*
 
Mine's not set to fall off until 2012 though, but SOL is up for me next year.  My scores got such a nice boost from the massive decrease it Utl - a bittersweet congrats to us both as we sit in fear for what waits haha
