Can a ca call you while you are disputing debt?

  I just get a call from my work that a mr. x just called me and wanted me to call him because he gets a busy signal when he trys, but no busy signal when work calls. Now this ca has been calling me on my cell phone for a few weeks now and never once contacted me at work. I just sent them a dv letter and now he calls at work? I lost it and asked him why he was calling that number when he knows my cell and has been calling me on that #? Then I told him I was writing him a letter telling him if he wanted to tell me something he could do so in writing and do not call me at work ever again. So he says when they received my dv letter my area code mysteriously got changed in the computer. I told him it sounded like he was being vindictive because of the letter. Then he tells me it will take a few months to get me all of the info I required and that if I don't settle now for $900 and they will not do a pfd, I will have to pay $1,800 in the future and if I did'nt pay they would get a judgement on me and something about it lasting 23 years?
  I just read the whole Fair Debt Collection Act and I'm unsure if he did anything wrong besides piss me off. Did he?

I believe he has to cease collection activity until he validates.  Also, you can tell him not to call you at work b/c your employer does not permit phone calls at work.  Once you notify him of this, he can't call you at work.

VIOLATION!  If you used the letter from here (or the many variations) - it says wriiten communication only.  What is the SOL for your state?  If he is threatening you and you are outside of SOL and can't be sued  - well, they can try and let them - file a counter suit for the violations) it's another violation and another $1K so let's see you $2000, them $1800 --- I like how this is stacking up.

i just got the cmrr green card back for a dv letter w/c&d for dw. oddly enough the phone rings and guess who. i advised per cmrr # you rcvd dv and c&d on 11/26, any further violation of dw fed rights will result in legeal action. collector starts stammering and says no info in her records. i cut her off and advise her she doesn't have to have the info in her records to be prosecuted under the federal statues for violating dw's rights. she snively says thanks alot and have a great day.
 
next time i get a call i think i'm making a trip to the court house.

Thanks Ducky,
I will write another letter stating very clearly that he is not to call me and must communicate in writing.
I also added some notes on the whole situation to my file.

Did you send the letter cmrr?  When did they get it (If you mailed yesterday they couldn't have it yet)... you need to know ehn they got it.

lady, if you asking me. i did cmrr it and they rcvd it 11/26. i even read off the number for the debt collector so there will be no confusion and they can run it down on their end. also, the csr failed to give me the mini miranda when i spoke with her (2nd violation). at least she didn't totaly trip all over herself and give me specifics on the account, coulda' been a threefer.

I actually sent it Express Mail overnight and it was there as of last Saturday. He even said on the phone he got the letter and it would take a few months to get me all of the verification info I requested. It just happened this year. I just found out about it when he contacted me, and it was just charged off at that point so I'm no where near SOL.

They have 30 days (not months) - give them the 30 then 5 to get thru the postal syatem then send them:

I'm sure you know, under FDCPA Section 809 (b), you are not allowed to pursue collection activity until the debt is validated. You should be made aware that in TWYLA BOATLEY, Plaintiff, vs. DIEM CORPORATION, No. CIV 03-0762 UNITED STATES DISTRICT COURT FOR THE DISTRICT OF ARIZONA, 2004, the courts ruled that reporting a collection account indeed is considered collection activity.

 

As of ( DATE that they received your letter) You have refused to validate this debt.Therfore you are in violation of FDCPA.

 

While I prefer not to litigate, I will use the courts as needed to enforce my rights under the FDCPA.

 

I look forward to an uneventful resolution of this matter.

 

I request that all contact with me be in writing, and only when you can provide adequate validation of this alleged debt. To refresh your memory on what constitutes legal validation, I am giving a list of the required documentation:

  • Complete payment history, the requirement of which has been established via Spears v Brennan 745 N.E.2d 862; 2001 Ind. App. LEXIS 509 and
  • Agreement that bears the signature of the alleged debtor wherein he agreed to pay the original creditor.
  • Letter of sale or assignment from the original creditor to your company. (Agreement with your client that grants you the authority to collect on this alleged debt.) Coppola v. Arrow Financial Services, 302CV577, 2002 WL 32173704(D.Conn., Oct. 29, 2002) - Information relating to the purchase of a bad debt is not proprietary or burdensome. Debtor must phrase their request clearly to obtain: The source of a debt and the amount a bad debt buyer paid for plaintiff's debt, how amount sought was calculated, where in issue a list of reports to credit bureaus, and documents conferring authority on defendant to collect debt.
  • Intimate knowledge of the creation of the debt by you, the collection agency.

As you are already in violation, I expect all reference to this account be deleted from my credit report, as this entry and any update of such entry will be considered another violation.
