Creditor harassment,what can I do?

I went to a place that offers no credit check financing for some furniture,not like a Rent a Center but a different place because they actually report to the credit bureaus monthly. I made my 1st month payment on the spot my next was due 2/9 and the account per their rules was put on auto draft. The payment posted to my bank acct on 2/11. Since 2/12 they've called my phone at least 3+ times a day saying I was past due, and sending texts. My work schedule is such that they are closed by the time I get off work,and truly there's no where private to make such a call back to them saying what the heck are you talking about. 
What should I do? Is there laws against this? I've sent messages to their customer service telling them there is an error that payment was made but no response is ever received.

However busy you are, I would make time during business hours to hop on the phone and straighten this out. If they're saying a payment is overdue this could wind up affecting your credit. Only way to know what's up is to call in.

I guess I have the don't call get it in writing ingrained too deeply in my head and try and get everything where I have a paper trail when dealing with creditors.

Just call them during your lunch hour or early in the morning before work.

Yes and no.

Harrassment is more than 1 unsolisited completed call in a 24 hour period.  Or calling before 8am/after 9pm.   A completed call means they reached a person, or left a voicemail.  

 

They could call multiple times in a day and not leave messages,  which only counts as harrassment if you've informed them specifically something or other I forget. 

 

The no.

the Fair Debt Collections Act,  was recently ruled to not apply to original creditors.   So they are allowed to harrass. I think.

You need to call them first and after that you can get things in writing. If this can be fixed with a 2 minute phone call vs 3 hours of hashing it over on a public forum then maybe you should make an attempt to get to the bottom line.

Do they have monthly paper Billings or an online system?

The FDCPA applies only to debt collectors, not credtiors, so the harassment provisions of that statute dont apply.

 

Harassment by a creditor would be a matter of state law.

I would contact your state agency that regulates consumer fianance, or your state office of the AG, for information regarding regulations in your state.

They only do auto-draft only for payment. So I called them. They still insist that I'm behind that they're having issues doing the draft that my bank account isn't allowing it and not only did they get a payment on 2/9, I have a pending payment to them right now showing in my bank acct. They want me to send them a copy of both payments showing they got the money. And they're insisting that I give them my checking acct number and routing information saying that's the way the account was supposed to have been paid from the start, I'm not doing that. I spoke to the bank and they said they can give me a statement showing when and where they sent the payment funds and it wouldn't have any of my personal information on it like acct numbers. This is the weirdest thing ever, this is just my 2nd payment with them I got the furniture in Jan.

ACH payments require account number and routing number. That’s as common as the sun rising every day. When one sets up automatic payments it requires you give them account and routing number. You may want to get used to this. While bills you can do many ways for say telephone or cable. Not so for many loans. If they don’t allow you to pay any other way, maybe you need to walk over there every month and pay in cash and get a receipt then.

The place of business that set this up used my debit card for the down payment and 1st payment and said they'd be charging my acct via auto payment on payment due date. He didn't ask for any checking acct information, if this is a requirement would this not have been asked for at the time the contract was written? And they are debiting my account and have for all payments due.The person said yesterday that they perfer everyone give them their checking account information to do payment instead of via debit/credit card. And my contract says they will automatically charge my account for each payment due but it doesn't state it has to be done via ACH. I have ACH auto drafts done I'm well aware of how they work, and those accounts required that I give them the routing and acct. number to set that up. I have other auto drafts that were set up using only my debit/credit card.
