Re: Do Code Enforcement liens appear on your credit file?

Go to the hearing!!!  In the city  where i am in Fl. They will fine give you time to remove the inclosure  maybe 30 days. Then they will inspect it again. IF it isn't done they will either extend the time OR start to fine you every day that it remains!!!!

You ask the inspector what needs to be done in order to keep it. It is not easy nor cheap!!!!

Get an attorney that deals with city codes any poss. real estate ( not just closing RE deals!!!!  you might be able to sue whoever you bought from.

I went through this lasy year!

I agree with Happy Days, Don't miss the hearing!!!   Consult with an attorney as to your options, I am also from Fla and we have some very tough building codes, especially in coastal areas. But!!! Don't remove anything until they specifically identify what codes you are in violation of. You bought the property as is. Did they have any code enforcement violation initiated against the previous owner???  If so, What??? I think you could have some legal recourse against previous owner for misrepresentation of property sold. Consult with an attorney!!!!

Re: Do Code Enforcement liens appear on your credit file?

I'm in Seminole county (Altamonte Springs address, but outside city limits). The house was actually a flip.  The previous owner bought it as a foreclosure, and the person who was foreclosed is the one who did the work.  (100% sure because I asked my neighbor).

A couple of years ago I received a notice of a code violation for a privacy fence, but I don't have one so the system is obviously a few years behind.  (The guy came out, saw that I don't have one and closed the case).  I don't know if there were any other violations.

The hearing is in May and I'm totally stressed at this point but I will definitely be there.  If I don't show up, who knows what they'll do.

Thanks for the answers!!

If you don't show up, they will enter a default judgement against you. I think if you go and explain the situation, they may be willing to work out a compromise. I would at least consult with an attorney prior to that hearing.

How much work are you talking about ?  If this is major, I would definately hire an attorney.  Don't ignore...they  will also put liens on the property so when you sell, it would be a real mess.

It's a carport that was enclosed to make a family room.  I would have to remove 2 walls, add a sliding glass door and a window.  Not a ton of work, but I don't have the $$ right now and I don't want to lose the space, anyway.  I'd rather do what needs to be done to get in compliance.  (Don't have $$ for that, either, but hey.  So goes life...)

Ignoring problems and hoping that they go away isn't on my list of bad habits.  (I do bite my nails, though.)

They might give you time to fix, and if you show good intentions, i.e. applying for a permit, perhaps you can stall enough to come up with the money.   However, I still would try to go after either who sold it to you, there agent, or someone.  You might even check with your lender...often they are the ones who catch these things during the loan process.  I don't mean go after them, but they may have checked it out.
