I have child support arrears with San Diego. On my Equifax report they have the account duplicated. I have disputed it at least 10 times, called Equifax, faxed proof to Equifax, faxed proof of the duplication to San Diego and it's still there. Everytime I dispute it San Diego reponds that the account is current an up to date. San Diego has told me that they have electronically sent to have one removed 2 times, but it's still there. I'm so frustrated and I don't know what to do. Can anyone give me some good advice?
I would first send the CRA a request for what is commonly called a "method of verification" of your prior dispute(s).
You are entitled, under FCRA 611(a)(7), to request and receive from the CRA a "description of the procedure used to determine the accuracy and completeness of the information" that was subject to a dispute. When they communicated the results of your prior disputes to you, they were required under FCRA 611(a)(6)(B)(iii) to have advised you of that right.
With the creditor apparently agreeing to the inaccuracy, and having reported that inaccuracy to the CRA, I would like to see how, in their method of verification, they substantiate a holding that the information was verified as being accurate.
If they still stick to their guns, waltz over to small claims court and sue them for improper verification under FCRA 611(a)(1).
