Find open date that was changed by CA?

Hi,

I have a charged off credit card on my credit report that should be about 5 years old. The charge off date should be in 2002 or so. I checked my credit report for that CO and its showing that it was opened just a few months ago (3/2007).

How do I find the REAL "open date" for the judgement against me. Its coming up on 7 years so I would like to see how much time is left.

Thank you in advance for your time,
Yohan

Re: Find open date that was changed by CA?

Yohan welcome,
Im confused. A CO (charge off) CA (collection agency) and a judgment are different

If you have a CO from a CCC there is a date on your report  opened & CO. CO usually comes after several missed payments. The dates are important for us to answer some of your questions.

what date did you open your credit card....was it turned over to collections if so what date?...Is there a CA reporting on your CR?

A judgment is different. do you know the SOL in your state?

READ THESE THREADS they will help you understand some things BUT do not be afraid to ask questions at any time!!

I just reread your message. It looks like you have a CA  collection agency. they are good at changing they dates.  LOOK at the name and post it here

Re: Find open date that was changed by CA?

Hi and thanks for the welcome.

Sorry I didnt explain it so well. I will try again.

I opened the credit card account around 1995. All was well until about 2001. I fell behind and didnt pay for about 3 months. Then the account was charged off around 2002.

I suppose the first time the bank started looking for the money was sometime in 2002. So the first judgement against me should have been sometime in 2002. Meaning my "open date" should be at that time correct? A little later on the Collection Agencies starting calling and looking for payment which means that the original creditor(the bank) had sold the debt to a Collection agency. It has since changed hands MANY times. Many different collection agencies.

Fast forward to NOW. My "open date" in my credit report is 3/2007.

How do I find the REAL "open date" from back in 2002? It is almost 7 years so I will be wanting to get that debt taken off my report when the 7 years is up.

I understand that when/if they changed the "open date" it is called reaging and it is illegal. What can I do?
I hope that explains it better.

Re: Find open date that was changed by CA?

Judgment means you have been sued and changes a lot of the conditions. I think you are misusing the word?

Have you been sued over this debt?

Re: Find open date that was changed by CA?

Collection Agencies have been contacting me for years about the debt. Since 2002 or so. Is that a judgement? Some have been law firms but when I looked up the firm it was actually a collection agency. It is all very confusing.

Never sued directly. Just phone calls and letters. Threats of getting sued but never served anything. Does that help explain it better?

Thanks for your help

Re: Find open date that was changed by CA?

Yohan,
Ok who is the CC that you opened your account with in 1995?

Is it showing on your report?
Example:    Capital One       date opened 1995

history    it might say sent to collections or something to that effect

Lets start there.  It might be that they turned or sold it to an CA

Re: Find open date that was changed by CA?

I've found this too on DH's report.  Not trying to step on the OP's post but it's a very similiar situation that might have the same solution

Had a repo and CO thru Toyota in 2000. Open date was 05/2000 and DOFD was 07/2000.  The debt with Toyota dropped off all 3 reports this month ~ with no disputing...just *poof*

Hilco Receivables the CA that I guess bought the debt from Toyota has fallen off EX but shows as a collection account on TU and as a derogatory account on EQ.

EQ shows no open date but the last reported date was this month.
TU shows an open date of 8/24/05 and a reported date of this month.
I disputed both of them as too old to be on the report resulting in a verification for this month.

Back in March TU report stated the account was to fall off 08/2007  and CSC (EQ) showed the date of last activity 09/2000 with no drop off date posted.

So should I just wait until next month to dispute them again if they are still there or should I do it now?  Has this CA reaged the account?  I don't want to DV as they are suppose to be gone soon ~ DH actually went to court over this but there was no judgement, this was before I was in the picture and he can't tell me what the outcome was because he's not sure himself.  Basically I don't want to dredge up anything that will make them come after him again.  Why oh why can't the credit bureaus get their stuff together??

I have a headache..I think it's time for a glass o'wine!

Re: Find open date that was changed by CA?

Kims  on the repo
falls off in 7 years yes    It looks like a CA took it over...they can not re age with the CRA

Now a creditor may still try & collect on a debt but  he is now under your state SOL as for filing a alaw suit.

In my state a CA may NOT file suit only the OC.

Send the a DV CMRRR  they might just go away. But you know when the DOFD was so if they try & B/S you and answer   send them a letter, with statue  telling them where to go. And that you will sue if they don't

as always ask the PRO's here before taking my word!

Re: Find open date that was changed by CA?

I'm just so leary of the DV with this CA since it may just go away in Aug or Sept.  I'd really like to wait...but on the otherhand I want it off the report so DH's fico will go up a little bit more.  Ticks me off because EX dropped it but EQ and TU apparently don't have the same info and looks like the CA verified.

Re: Find open date that was changed by CA?

I know how you feel. I just sent a dv to a CA and I know that it will drop in Oct -Dec. But I don't even think its mine & I do not trust the CA to let it drop!  So I figured I have nothing to lose and maybe PO the CA.
