Yohan,
Ok who is the CC that you opened your account with in 1995?

Is it showing on your report?
Example:    Capital One       date opened 1995

history    it might say sent to collections or something to that effect

Lets start there.  It might be that they turned or sold it to an CA

Yohanm answered: -- I believe the credit card was opened in 1995 with citibank.  It was indeed sold to many collection agencies.

It shows up on credit report as follows:

LVNV
past due: $2,721
term:1 months (only reported by experian not the other 2)
opened: 3/2007 (it was in fact opened in 1995) then charged off in 2002 or so. So 5+ years was added??
reported: 6/2007
responsibility: individual

Re: Find open date that was changed by CA?

If i am not mistaken the date opened is the date that CA got your account and started trying to collect. It has nothing to do with the DOFD or Date of First Delinquincy. This is the date that the CRAs use for reporting time on your CR. Also the time the SOL on the account starts from.

Re: Find open date that was changed by CA?

Thanks.
How do I find the REAL DOFD?

So how do I find out when my 7 years is up?

2007 minus 5 years = 2002.
So I should read 7 years and removal by 2009 or so, correct?

The only was I have found is to call EQ and ask, or when you try to submit a dispute online for Transunion, you get a report, and it will have delation dates on it.

I just called TU to get a DOFD for a closed utilities account and the customer service rep looked it up for me.

Re: Find open date that was changed by CA?

Yohan, be sure to check your SOL for the state that you live in.Because you are close to the line.
The state SOL has nothing to due with the CRA.
My state SOL is 6 years. It ONLY means that the CA can not sue me!

The CA are known to  using the date that they take over your debt as opened. This does not affect the DOFD.  But can can scare the crap outta ya!

As someone in here told you, call the CRA and ask for the DOFD. That is when your 7 year count down starts. They MIGHT even tell you when it will drop.

If your state SOL is past, send the CA a DV letter & (you will find them on here)  add to the letter that you want Signiture DOC.     and COMPLETE history.  Sometimes the CA (citi) does not keep them & never turned them over to the first CA. IF that is the case you are ok.

Send the DV letter  CMRRR.  and only wait 30 days for an answer!!!! after that come in & ask for next letter that you will send

If the CA doesn't answer or answer with full doc's  they must stop all collections.

DO NOT at any time talk to them!!!!!  everything by mail in writting!

LVNV  is very nasty so you will need to to everything by the book & you might catch them in violations & can sue.

Re: Find open date that was changed by CA?

Hi and thanks for the welcome.

Sorry I didnt explain it so well. I will try again.

I opened the credit card account around 1995. All was well until about 2001. I fell behind and didnt pay for about 3 months. Then the account was charged off around 2002.

If you fell behind on your payments in 2001, that would make your DOFD what ever time it was in 2001. Seven years from that date is when it should drop.

Citibank tried the same thing on me. They purchased my account from another CA, they dated mine for sometime in the last six/seven months. I disputed it earlier this month with EQ and it immediately came off my report this month. It was due to come off Aug. 2007. TU and EX automatically removed it from my reports without dispute. I think Citi does this to try to trick the CRA's into keeping it on there another seven years. If the CRA's don't catch it, it will stay on there.

Because of this forum that is how I found out Citi had done this to me. Many people like myself don't often check our CR's because we know that we are on a downhill slope, and believe that there is no hope for ourselves. Those of us that think and feel that way don't pay enough attention to the details on our reports when we get them. We just pay attention to the actual OC or CA, and think, yep it's there and will be there for a few more years. Thats all many of us do. We don't know any better. When I noticed it on my report, I knew it was wrong and could not be done. That was when I disputed it.

These forums have made me think differently. I have been hooked now for a couple of months, and that is all I think about-rebuilding my credit-rebuilding my credit. I go to bed thinking about Fico forums, and get up in the mornings thinking fico forums.

From these forums I have learned so much crap that is unbelieveable, the tricks that CA's try to pull, some of the things the CRA's pull off...like selling our good information-making money off of us. Selling information on someone's location and financial situation to a CA when they see a change or improvement in their credit or employment. I have always thought of myself as an ethical person, but not when it comes to credit...I am not the least bit concerned with what is or isn't ethical. Normally I would, and still do turn the other cheek. But not when it comes to CRA's and CA.

My BK is off of all three CRA's as of this month, and a few disputes that the CRA's have to remove because they were included in my BK should be off any day now. That will leave me with only two derog on my reports. One CA for a hospital bill that I was paying on, and only liked $350.00 paying it off. It was recently reported only a year ago. I have PFD'd them, so far no answer. The Crapital One, it comes off in about another year and a half. I have PFD'd them too. Still no reponse from them yet.

So please everyone, keep your fingers crossed that both the CA and Crap One excepts my PFD's, and those of you who pray, please say a small prayer for me tonight.

Re: Find open date that was changed by CA?

Hey CJ, as to crap 1.....should drop in 2008.  IF your DOFD is Oct 2001...it will drop between Oct & dec 2008. Your report might give you a drop date  mine did.Check your state SOL.
Crap 1 is know for adding all kinds of charges.

Ya got my prayers!

Re: Find open date that was changed by CA?

YOHAN, I just noticed that .....TERM  1 month...lmao    they tried that with me also. I believe they are trying to make it look as though you only have 1 month to pay or else. It's B/S

But as I said before  they are very bad!!!!  make sure that everything that you do is in writting & mailed CMRRR. keep everything & copy it all. even the green card.

Make sure of you state SOL  so you know that they can not take you to court.

These people have been sued many times for all kinds of violations.

Re: Find open date that was changed by CA?

I am have been fighting with the CRs (mainly EQ) but nobody listens - LVNV has listed a Providian account with a BS DOFD (it was Oct 2002) that I missed the first payment...they have it listed as the CC Acct #; the second listing by them, they changed the date to 4/2004 - showing NEW & OPEN, 120 days late which is crap because I've never made a payment...AND they changed the first part of the Acct # to PROVIDXXXX - I've pointed this out several times to the CR and they WILL NOT change it.

Just received my latest report, showing the SAME thing - what do you do?!!

I would be VERY careful with LVNV - they are definitely sneaky and I had (3) agencies within 3 months (two years ago) try to collect for the SAME acct.

Told the Judge a few weeks ago that I have NO proof they have the authority to collect and I offered them one penny for every dollar DUE, I can prove it because I happened to find my last statement from Providian.

GOOD LUCK
