Here's the situation I'm in. Back in '04, I had a dispute with my landlord that led to an eviction action. But I left the apartment before that happened, although I still had to go to court and deal with the money I still owed. The landlord's attorney was able to secure a judgment against me, under the stipulation that upon payment he would file vacate paperwork. In October of last year, I started communicating with the lawyer about paying 65% of the balance and having them file the vacate paperwork. We agreed to the terms orally, and then I sent a CMRRR letter outlining the terms. And nothing happened, I never even got the Green Card back or the original letter! So a few months went by, and I still had the 65% of the balance in a savings account. So I contacted the lawyer again, only this time the phone number came up as fax number. I did a google search and came up with three different addresses, so I sent three CMRRR letters to those addresses. One came back "Return to Sender" and the other two never came back at all - green card or original letters. A few days ago I was looking to move into a new apartment, but the landlord denied me claiming I had been evicted -- which wasn't the case. So I went to the court house to find out how this judgment was being reported. Now it's being reported as a judgment, and I even get the address list again -- one of the addresses happened to be near the court house. So I drove over, the building was effectively abandoned. No cars in the small, weed-infected parking lot, and all the numbers on the security call box came up - "This Number is No Longer in Service." I have the money to pay and can't reach the landlord or his attorney to make payment. I figure I can file "Vacate Judgment" paperwork claiming that the landlord and/or his attorney have failed to make themselves available to receive payment -- it's been 9 months since I've been trying to track them down and have them accept payment! Does anyone have any suggestions on how to make this Vacate Judgment paperwork go down smoothly in my favor? Thanks in advance.
