I opened a Verizon account 03/24/08.
I closed the account a few weeks later as I was moving out of state. I stopped in a Verizon store the end of April 04/08 and they told me everything was paid up and I explained that I would not receive statements as I was moving.
08/08 I get a notice from a collection company. I called Verizon 08/30/08 and they said that I owed $175 in fees and that the earlier statement by the store was incorrect. After discussing it awhile, they agreed to remove $37.86 in fees and said they would notify the collection agency, it wouldn't go on my credit report, and that I should just wait for another statement.
10/12/08 I still had not gotten a statement so I paid $100 to the collection company via there website.
Yesterday, 10/20/08 I get a notice from myfico, I log in and see a charge off for $175 listed.
My question is, do they have to wait 180 days to report it? I thought I read that somewhere.
If not, what is the best way to dispute this?
Also, I called Verizon again and they had not record of the $37.86 credit, although they again agreed to do it and this time connected to the collection agency with me on the phone. The collection agency at first said they had no record of my payment, until I read them my confirmation number an then they were able to find it. They now say I owe ~$30 dollars but said only Verizon could remove the CO from my report (Verizon told me today only the collection agency could/would).
One of the most important things that you will learn on this forum....everything in writting!!!! You always want proof!!
Mail a letter to Verizon ( use the addy on your CR). This will be a GW letter. You need to state that you did talk to CS from Verzon and was told the $ 37.86 was to be shown as a credit. Also You were told that Verizon would pull the account back from the CA once you paid them.
An OC must report the closed account or CO within 90 days. This is to be sure that the DOFD is correct.
Everything in writting
Never talk to a CA!!!!!
Never pay a CA unless the account was sold by the OC!!!!
Thanks for the reply.
Is it true that a charge off can only be reported after 180 days have passed? I have found several indirect references to this, but no direct reference of the actual law. I imagine it would be a part of the FCRA.
NO!!! An account can be closed by the creditor for any reason!!! If you miss payments & they are going to close it for non payment....they must report this to the CRAs within 90 days!!! this makes it clear what the DOFD is. They can at that time report it as a CO or they can wait.
Well, 90 days would have been around July 22nd 2008.
Does waiting too long mean it should be deleted?
