How many months of not reporting before you dispute?

Cap1 issues:

New card was supposed to report and hasn't yet

Cap1 Auto finance hasn't updated in 2 months (last update was April)

I ordered my reports yesterday and new card isn't on there and auto hasn't updated my last two payments (5/16 and 6/16 - due date 17th of month)

How long should I go before disputing?  I don't want to dispute but I need my card to start reporting and my Cap1 Auto is my worse account (late payments) so CRA's not having my new on-time payments is hurting me.

Thanks,

Duncan

The CRA's can only report what is sent to them by the creditor. I see no basis of a dispute with the CRA's.

Cap 1 seems to be the problem and they are the ones you'll need to contact.

I meant dispute directly with Cap1.

I would call Cap 1 and just ask what is going on. There might be a glitch somewhere that has caused the delay. Making them aware of a problem could be enough to get things moving.

That's really all you can do. Creditors are under no legal requirement to report any account at any time. But if they do report to the CRA's the information is supposed to be accurate.

This happens with a bunch of lenders, even Wells Fargo neglected to update the balance on my auto loan... but it really doesn't matter.  The tradeline will update eventually, and as long as it does before you apply for something, it just doesn't matter.

The one thing I would recommend, if you're just letting the balance stay consistently at some flat number each month (call it $0 but probably any fixed value would do) it appears to increase the odds of a non-CRA update of the tradeline.  This is just from my own experience and also from what I've read from other posters here.

Re: How many months of not reporting before you dispute?

.

FCRA 623(a)(2) mandates reporting if:

1. The information at issue was previously reported to the CRA, and

2. The information has changed in a manner that it is no longer complete or accurate.

If those two conditions apply, the information must be "promptly" corrected and updated.

There is nothing inaccurate about unreported information unless it is related to previously reported information and necessary to maintain the accuracy of that information.   Some creditors do not even have reporting agreements with the CRAs, and reporting is not mandated.

I see no basis for dispute of lack of initial reporting of information.

I disagree. It a OC elects to report the fact that they don't report the following months activity is in fact not accurate reporting. They can not sit by and only report negative info and then not report positive on time payments.

FCRA 611(a):

"If the completeness or accuracy of any item of information contained in a consumer's file at a consumer reporting agency is disputed....."
