I need evidence to show statue of limitations has expired.
But my credit report for Experian, Equifax and Transunion no longer has it listed, its been deleted.
I need to be able to show in court the date the card went into default.
Any advice? WIll be much appreiciated.
Experian says they dont keep old reports or what was it.
Do you have old statements? Any old reports when it was on the CR?
Was it deleted due to aging off?
No old statements. There all gone.
And it was deleted due to old age.
If you happened to apply for a mortgage anytime prior to it's deletion, you may be able to get a copy from your lender... they have to keep it on file.

Even if you apply for a mortgage and it has already been deleted from the CR it will still be in the OP file. Your entire credit history can be seen under a few circumstances. Applying for a mortgage of $150,000 or more is one of them.
What you need is, in my opinion, not prior credit reports, but only what is currently in your credit file, not prior consumer credit reports.
CRs dont store statute of lmitations. Those are state-specific legal issues,. They are not credit reporting issues
If, however, you know your state SOL law, and are attempting to retrievce relevant dates from your credit file that then enable you to determine your SOL (such as current DOFD on an OC account, or last reported payment), then you have recourse to FCRA 609(a)(1).
This section of the statute enables you, upon payment of the fee set forth inb FCRA 612(f), which is currently $10.50, to obtain any information in your credit file.
Just specify what you want, pay the fee, and the CRA must provide what you want from their current credit file.
Specfically request the "FCRA Compliance date/DOFD" in your credit file.

i just called, the guy told me once its off its off. i know this isnt true, but he advised bme to call the original creditor and try to get the info.
I dont think he knew what he was talking about.
is there a particular way it needs to be worded?
My last option will be to apply for a $150,000 loan. That will show them.

I actually found a real sweet lady who saw the info, but said she couldnt legally send it to me. She did it as a favor. But she can only send what is visible on my report.
But to my surprise, this is the information she told me.
Original delinquent was nov. 2002 – sears
Dec. 06 – LVNV removed
Yet, as you see, she said LVNV removed it on 2006. but yet, LVNV pursued a judgment on me in 2007 and won by default.
I got that judgment overturned in 2010. but we still are going there to determine what i owe. I just need to prove that it was pass the SOL.
