Just got a hard pull. Next Steps help please!

I just check my report and got a hard pull from Cavalry Portfolio (3/11) drop of 11 points Ex.. Should I have received a notification of some sort prior? I have nothing hiding that I am aware of.
What should my next steps be here to **bleep** this in the bud? ANd get my points back!
 
I look forward to your suggestions.

Cavalry Portfolio  is a CA...they do not have PP to do hard pull.......on the other hand I have never seen a score drop just for an ing....check your CR and see if they started reporting an old debt.

I have noticed that you have placed an inquiry on my _________ credit file dated ________. As you probably know, Credit Reporting Agencies treat inquiries as a statement of fact and will not allow a consumer to dispute them. Since it is against federal law (Fair Credit Reporting Act -- 15 USC § 1681n(a)(1)(B) for an entity to view a consumer’s credit report without a "permissible purpose," I am writing to inquire as to your alleged purpose for doing so since I did not apply for employment with your organization nor did I request credit from your organization.
 
[Describe any additional details about the inquiry here if need be. For example, your a subscriber to XXXX monitoring service and XXXX company pulled a "hard inquiry" on one of your reports.]
 
Based on the evidence in my possession, this inquiry was performed under false pretenses as described in the clear language of the law. 15 USC §1681n(a)(1)(B ) states, in part, "in the case of liability of a natural person for obtaining a consumer report under false pretenses or knowingly without a permissible purpose, actual damages sustained by the consumer as a result of the failure or $1,000, whichever is greater;"
 
You are civilly liable to me in the amount of $1,000.00 for your willful violation of the law -- performing a "hard inquiry" on my __________ file without my permission. I do hope that we can settle this matter amicably. You can remove the inquiry within one (1) business day of the receipt of this notice. Or, we can meet in court where you will end up removing the inquiry, paying me the civil liability fine, punitive damages for my score drop, plus court and attorney fees. The choice is up to you.

I just did a version of that letter to Quicken Loans for a non pp  tri pull and my  idiot credit union for one to EX all are being deleted  by the end of this week....
 
Quicken is even reimbursing me the cost of the three bureau report and scores that I had to pull  to find out who did the inquiry when I got my alert....
 
I averaged a drop of 16 pts across the board  with the pulls....and so help me...if  they  arent back when the inq's are deleted you had better bet Im going for the full $1,000 in civil penalties, as both admit to in writing with signatures that  the pulls were made in error.

Thanks again!  Letter will go out tomorrow CMRR!
 
I want to make sure I put an end to them.  Should I file complaint with the AG's now or give them 5 days?
 
If anyone knows of an attorney that loves to go after bottom feeders like this on let me know. Northern Cali area. Smiley Wink

Well, as much as happy is pretty right on almost everything here....there are differing opinions as to whether a CA who owns or is assigned an account has a PP for a hard pull.  Some interpret the allowance to pull credit reports for "collection" purposes as a PP.  The FCRA does not note the difference between soft or hard. 
 
I WISH you were right...I just got dinged by NAFS on  hard pull and lost 3 points on eq....for a debt that is 6.75 years old, and is long out of SOL and is actually owned by Cavalry!! (Sometimes even JDBs let CAs try to collect for them!!) Of course Cavalry has also pulled hard on EQ for this same debt...but at least they are reporting it. 
 
So, I will be curious to see if your letter works....for me since the debt drops off soon Im gonna wait until its gone to get nasty at all since I dont want to get the thing re-aged or something stupid...

Any new news about the outcomes of these letters?  I have sent some last week and wandering if they did not remove what the next step would be?
