Medical Collection Question

Hiya!

When it comes to medical collections, can they report on both the insurance holder's and the patient's (spouse) credit report for the same debt?

I'm not sure they can do that.  I'm in Texas and my dw has 4 medical co's showing up on her report which she trying to dispute, and she was insured under my ins policy.  To date, none of them have shown up on my cr (knock on wood).  I belive when you sign the paperwork at the Dr.s/Hospital, there is a section that states who is responsible for the debt, and my dw just listed herself.  Hope this helps.

Unless the spouse signed as responsible party they cannot.  If the spouse did sign I believe they can only go after the spouse. Unless of course the patient agreed to payment upon release.

The state SOL requirements are not a factor as medical accounts are considered "services" and are under the standard UCC 4 year SOL.
 
Send the medical dispute letter (search Google for "Why Chat letters") on any accounts that are on your reports, if the accounts are completely verified by the OC through the reporting CA to the CRA, PAY THEM!! (of course with the HIPAA letter directly to the OC)
 
The only time you need be concerned about SOL on medical debts is if you are being sued on a medical debt that you have no other defense on, i.e. "it's not yours, it was paid by insurance, or should have been paid by insurance if it had been properly billed, it was an inflated bill that you had disputed etc."
 
If you are being sued on a large medical bill, particularly from a Hospital, there is likely no "useable" SOL defense, (if that is your only defense), as unpaid medical bills from Hospitals are paid, (reimbursed) by the State from taxpayer funds and the Courts have held that it is an indirect "Governmental" obligation.

OK, I found the info on a HIPAA letter, but a little confused.

If I haven't already pd them in full for what was a VALID debt, do I send this letter (HIPAA)?
If I have already pd the hosp for the bill after it was sent to collections do I send this letter?

and the pre hippa to the cra, is that only for medical debts that are not valid?

If someone can break that down a little - I'd be a happy jcmycology Smiley Happy

Anyway you can do an internet search concerning the HIPAA process. For various reasons we are not allowed to talk in detail about how all this works. But the information is out there. Good luck with this.

Hi G-ma,   You have a medical collection with a CA (collection agency)?

 

I had several medical debts with CA's, I did not know about the HIPAA process when I was repairing my credit.

So I just used the PFD Letter and all of my CA;s were removed.  Maybe I was just a Lucky gal, I dont know.
