Need Advice

So i had a old charge off fromm2001. This has fell off my my reports a few years ago. The creditor Called today  . If i place a Freeze on my reports will this stop them from reporting ? I'm not even sure they will beacuse of SOL..  I was young and dumb. The Original  debt is from Cap1.I dont need this hitting my reports right now ... Also i pulled a current report from equifax and shows no soft pulls from anyone new,


Starting Score: EQ 729 TU 727
Current Score: Ex (AMEX) 765 EQ 734 TU 736
Goal Score: 780+

Was the CO from 2001? In other words, was the DOFD prior to that point? If so, they cannot report. They can call. They can collect. And in most states, SOL will likely be over. But they can legally no longer report because the 7-7.5 year CRTP is up. I personally would ignore them.

This can't legally be reported. The CRTP (Credit Reporting Time Period) for charge offs is a maximum of 7.5 years from the DoFD.

 

What state do you live in? The SOL for credit card debt has probably expired but you need to confirm that.

 

But the debt remains even after the SOL and CRTP have expired so collection efforts can go on.

Do you mean DoFD? That's the Date of First Delinquency. Collections and charge offs can report for no longer than 7.5 years from the DoFD on the OC (Original Creditor) account that led to the collection or CO.

 

Once the CRTP has expired they can never (legally) be reported ever again.

You should just send them a CMRRR letter stating that they are to no longer call you.

 

They can send you letters until they run out of stamps but if you instruct them to stop telephoning they must comply.

Expiration of a credit report exclusion period does not bar any reporting to a CRA.

 

It is a requirement on the CRA to exclude the information from any credit report they issue after that date, not a reporting bar on a creditor or debt collector.

In some rare cases, as defined in section 605(b), such reporting could still be included if the inquiree qualtifies under one of the exemptions from CR exclusion.

 

If items remain in your CR after their exclusion date, it is not a reporting violation of the creditor/debt collector, it is an exclusion violation by the CRA.

Thus, remedy is not to dispute with the creditor/debt collector.

That's correct. If it shows up you can dispute with the CRA's as being obsolete, out of date, etc.
