Need payment advice for collections

Hello everyone,

Heres my present situation. I have got two NCO collections off my reports..I have one collection left from 10/04 with no activity. I have tried to contact the creditor, account sold to ..., and re sold to ..... so now after being sold 5 or 6 times, the new collections dept has contacted me, i tried for PDF however they are not willing to do so and have in fact threatened me with a judgement if I refuse to pay! the account is $1001.00. If I pay, the account will show active again?

Re: Need payment advice for collections

Did you send a DV letter and (after it was received) dispute with the CRA's?  If not, that's what I would recommend.

If it's validated and confirmed to be yours, and the CRA's did not delete it, then I would send another PFD letter.  Include a sentence about them only contacting you in writing, not via phone.  CA's will almost always threaten to sue, but most times they won't actually sue.  Given the choice between getting $500 with a PFD, or going to court to hopefully win the full $1,000, it doesn't really make monetary sense for them to go to court.  And for them, it's all about money.

Re: Need payment advice for collections

DV sent and the debt was validated. There is no collection showing up on my report however this has been bought and sold by collection agencies since 1994.

My question is, if I pay will it hurt my fico score. I should add, this collection co. pulled a hardie on me and then threatened me with a judgement if i refuse to pay. My thoughts are that they see I am cleaning up my report and think they have me by the short haires ...so to speak..

What are the chances that they will issue a judgement for $1000? I asked for PDF at $800, they refused the delete alltogether saying they are not authorized to delete this account since they did not report it!? and second, they say since it is such a small amount they cannot reduce it at all.

Any Advice?

They're not on your credit reports, and the debt is from 1994? If the debt is that old, I'd imagine that it is FAR beyond SOL and they can't sue at that point. If that's the case, then they have no basis for making you pay. It's just something you might want to do for your conscience, but they can't be on your credit report and they can't win a lawsuit against you.

If you do pay, I believe it would bring it current so you'd have a Paid Collection from the month you pay it. This would drop your score.

Re: Need payment advice for collections

If this has been bought & sold since 1994 it is WAY past SOL and CRTP!!  CRTP and SOL go by the DOFD or DOLA   Are you sure about the date??

The creditor is Household Credit services DOLA 10/2004

Activity Description: Transfer sold/paid

There is no collection information on my report.

Re: Need payment advice for collections

My question is if I pay this account will it then show up as a collection or just remain as is on my report? What are the chances of a judgement being issued for this if I continue to hold out for a PDF ( which by the way the collection co. says they have no control over!)

SOL stat of Ga. is 6 years. My report is looking very good. I have gotten two nco collections off and raised my total score over 78 points all together! now this collection co. just pulled a hardie on my report..I assume they see iam cleaning up my report and figure this is a good time to harrass me.

This is the choices they have given me over the phone:

1. Pay in full now
2. Make payment arrangements..may still have judgement issued..in which case will be out of their control?
3. Dont make any agreements on or before Jan 3. Judgement issued!

What to do! I desperatly need to keep my score high and get it higher, but it seems i may be stuck beteween a rock and a hard spot here!

Re: Need payment advice for collections

Because this is within SOL I would try a PFD for the full amount owed.( if you can) otherwise make payment arrangments. BUT PFD
