A quick question about a PFD letter to a OC of an account you know to be yours. When you write the letter, do you still include that "the validity of this debt is disputed..." etc? Even if you know it to be yours and the letter isn't to a stinky CA?
'Stinky CA' is a technical term, by the way.
Thanks!
Hi Cake Girl,
It is my understanding that the DV process is for a CA and for the most part, the PFD is for a CA as well. You can always ASK the OC for a PFD, but IMO, it is unlikely. The OC does not have to respond to any debt validation and probably will not respond.
My strategy would be based on who owns the debt - if the OC is reporting a balance, they still own the debt - however if it listed on my credit report as $0, they sold the debt, nothing you can really do at this point but work with the CA. It would be in my best interest to PIF the OC, before a CA is chasing me down, going to report. Then you can always GW the OC...
I hope this is helpful.
Thanks, daisyduke.
It is still owned by the OC and reporting with a balance of $721. To be extra sure, I called their in-house collection department to be certain it hadn't been sold. It hasn't. So, I'd looooooove to PIF for delete with the OC. I know it's a long shot and, should it not work, will PIF then GW. But would like to try PIF for delete first.
So, I don't need them to validate, just curious if I it's safe to leave out the validation language when writing the OC with the PFD letter.
Thanks!
HI Cakegirl,
OC"s do not validate debts.
I would definately pay the OC then, they are listing a balance on your credit report.... You can always ask the OC for a removal of the tL if you PIF, but it is probably highly unlikely, but you never know... Worth a shot. Paying the OC cuts the CA out of the picture and all the work it takes to get a CA off your report...you can always gw the OC down the road and hope for the best..and know that no other Ca's will be calling, sending letters, etc.
Good luck CakeGirl.
Thank you!
