PFD Response

I sent a PFD to a CA for a dentist, and the following came back. I X'ed out the bank account number. By the way, it is totally worth the $526.73 for me to get this off of my credit report, I just want to make sure I'm not being stupid here. Do you think it's safe to deposit the cash in the CA's bank account and expect them to delete the account from the credit bureaus?


Please find a copy of the statement of charges and payments.

In order for us to agree to a deletion you would need to pay cash only. No certified funds, money orders and or personal checks at any Bank of America our account # XXXXXXXX.

Deposit in the amount of $ 526.73 must be made on or before 4-30-08; any deposit after this date and or any deposit made by any form other then cash voids our agreement to remove from the credit report.

I would want some proof that the bank account is actually connected to the CA and not to some sleazy bribery-on-the-side supervisor! Juuuust to be safe. "Meet me at the pay phone in the back lot of Circle K. Wear a baseball cap. Come alone. Put the money in a plain paper grocery bag.. The signal will be you taking your hat off." HAHA!
 
And also maybe clarification that by "deletion" they mean "deletion of the entire tradeline from each of the three major credit reporting agencies"!!!!

I guess I should have included the letter I sent to them. I pasted it below (ommitting names to protect the guilty). The letter is sent on their letterhead, and the return address on the envelope is theirs, and they included the statements for the account. So, I'm not too worried about this being their personal account. Plus, when I make the deposit I can verify the account name at Bank of America:

To Whom It May Concern:

This letter is to inform you that the validity of this debt is disputed. I am not sure of the account number, as I have never heard from you regarding this account. The account number I have is the one listed on my Experian credit report – which omits the last few digits.

In the spirit of compromise, I am willing to pay this account IN FULL if you agree to immediate deletion of this account from any and all credit reporting agencies (Equifax, Experian and TransUnion). The purpose of this settlement is merely to have this item removed from my credit files. It is not to be construed as an acknowledgment of liability for this debt in any form.

If you agree to the terms and accept this agreement, certified funds for the settlement amount of four hundred and ninety-five dollars ($495.00) will be sent to CA in exchange for full deletion of ALL references regarding this account from my credit files and full satisfaction of the debt. As certified funds will be used for payment, there shall be no waiting period regarding the deletion of this account from the credit reporting agencies.

This doesn't sound right to me.  What is your SOL and the DOLA?

This is actually from when my ex-wife took my kids to the dentist and never paid the bill. I never got a bill and the first thing I knew about it, it was already on my credit report. I sent out a PFD to the CA months ago, and they called me. Then I called the OC and sent them a PFD, but to no avail.

I'm guessing SOL would be 6 years for Washington state since it's considered a written contract? I never signed anything authorizing treatment or anything like that, but if I can get this off my credit reports for under $1,000 it will be worth it to me. I just want this off my report. Experian says it is scheduled to continue on record until Dec. 2012, so I'm guessing that means Dec. 2005 is the DOLA?

My cousin who's a mortgage loan officer says that I should go ahead and pay this off. If I pay with cash, I can save the deposit receipt that B of A gives me. From their letter, it sounds to me like they're agreeing to the deletion if I pay cash.

I would not deposit the money into an account until I knew who the account holder was.
 
That seems really odd if you ask me.
 
It hasn't been that long ago when someone posted a link to a news story about a CA employee being caught stealing thousands of dollars from customers. The employee was depositing the money into her own personal account I believe. I am sure this isnt' the first story of its kind.
 
I'd take the letter to Bank of America and ask if they can verify the account holder's name before depositing the money.
 
If they can not, I would call the CA and ask for a supervisor(not the one who signed the letter) and make sure this is the CA's bank account number.

Yep, it struck me as a little odd too. That's why I posted it here. When I've deposited money in to my mom's bank account at B of A before, I've always asked the teller to make sure that the account number matches the account name that I've given them. I'll do the same thing here. If it matches, then I'll deposit the money and send the CA a letter with the deposit slip receipt attached. If it doesn't match, then I'll contact the higher ups at the CA (and the OC too).

Make sure it is just a copy.

This is one time I would call a CA. I would speak to someone else and play dumb. I would say that your CA rep Joe Bag O' Donuts told me to deposit money into an account at BofA. But unfortunately, I lost the account number. Could you give it to me again? .......Of course, I would ask for a supervisor, rather than Joe to confirm this.
 
Then to double check, I would go to BofA and be totally up front with the situation. Mention that you suspect fraud. Then tell them that you know you can't give info on other's accounts. But if I gave you an account number, can you please verify that it belongs to the CA? If it belongs to an individual, does it belong to Joe?
