My only critique is that it seems to be half professional and half amateur. I would take out parts such as "not verification of a stupid statement summary" and "I would rather not waste my time having to drag you to court". When they read that, they'll probably assume that you had no legal review of this and may not actually take them to court. By using 'stupid', it might also make them less likely agree to what you're requesting.

Friendly question: how far are you willing to go through with this? I know some here have gone to court and settled and/or won. Does anyone have any success stories?
 
I'm not a skeptic. I have seen other stories on the web with consumers winning 6 figures easy. For me, IMO, I'd rather have it deleted off my record than get $$$$$.
 
Keeping it germaine to the above letter, has anyone had any experiences going forward with the above caselaw?

I received an out of court settlement of $300+ and deletions of INQs and COLLECTION account. That is the most thing I got out of threatening a CA.

As for the person who said that I might want to remove the stuff that sounds "half" professional, such as the word "stupid." I'm not a lawyer, I want them to see the personal side of it, because it is personal to me.

I want them to know that I'm livid. I want them to know I'm angry and know my rights and that I am FULLY prepared to fight them in court and sue for everything I can. I'm so sick and tired of these companies using illegal tactics, and trampling our rights to coerce and intimidate people into paying them money.

For those that wonder, yes, I'm fully ready to take this as far as I have to.

Federal judges don't care. Very Joe Friday-esqe. Just the facts.

They don't care. It's of no relevance. They only care if they believe you're gonna sue 'em and win.

You'll probably need a lawyer when going into court. Local courts you can do pro se, but once you're into the federal system, then you'll want representation. If the lawyer thinks there's a case, they'll be interested in representing you. If there's a violation there, then there's money to be made by them, and you.

I would curb the venom - keep to the facts and only the facts. If I were a CA reading the letter (and realize it will be seen by a lowly associate before anyone else) - the venom would insult me more than frighten me.
 
A fact is the damage to your credit report and standing which you can claim damages for.
 
A fact is they failed to validate and have continued collection activities
 
A fact is that you would prefer not to resort to litigation but will proceed i that is the option they choose.

Well, unless you're willing to hijack a USPS trailer, I suspect you'll soon find out.

Well, is there a huge chance now that they'll just laugh and tell me to FOAD? Or is there a greater chance they'll take me seriously even though that stuff is in there?

I'd really hate to have those 2 words screw up my chances at sticking it to Cavalry. Smiley Happy

If they do it in writing, and spell it out rather than abbreviate, it's probably a solid violation--FOAD that is.

Hard to say. All depends. I mean it's not a violation of law or anything for you to be snippy with them, and I daresay if they remain hardheads and go to court, a decent attorney could mitigate it, assuming anything came of it.
 
Your honor, I think this is but an example of the frustration my client felt in trying to settle this matter in good faith.
