Unauthorised access to checking account

Hi all,

 

An unauthorised person (geneal contractor doing some work for the owner of the checking account) accessed a BofA account through a contact (staff) working at the bank. The owner of the bank account (my friend) has evidence of the contractor having access to the data (he stupidly attached it to a legal letter to her), and the staff member at the bank who helped him get the data (BofA helped her get the info)..

 

I believe this is a federal crime but we are not sure who it needs to be reported to.

 

Can someone please advise who to report this to (police, regulator ?) and the process.

Take all evidence to the local PD. Get a case number. Ask PD how you should handle it. They pobably will send detectives and go over all these transactions and then file charges against both of them. Along with the bank pressing charges.

In addition to this ^^^ go to FTC.gov and read up on the steps for ID theft. The first one is filing a police report (as posted by FireMedit1). You have additional ammo because you know who it is that breached your account.

Was any movement of funds involved?  If any funds were touched/moved, in addition to the above responses, this could also be a theft.  Depending on the amount, if any, it could also be a felony.  

 

Also, in addition to the advice to file a police report, which absolutely should be the first step, contact the state Attorney General's office; most states have a Division of Consumer Affairs or some such title, to assist in guidance in such matters.

 

Also, contractors have to be licensed.  Contact the state agency that is in charge of contractor licensing and file a complaint.  

 

Go to the BofA branch in question, speak only with the branch manager, detailing what has happened, and that the above agencies are/have been notified, and then sit back and watch how high that branch manager can jump!  There should be an internal investigation at minimum, and someone should lose their job.  

 

IF, in the off chance that BofA does nothing, resort to social media, ie, BofA Facebook or Twitter account and complain publicly.  THIS will get BofA's attention real fast. 

 

Google search for consumer complaints, or pissedconsumer.com type sites, and post publicly there.  

 

Do everything humanly possible to make the life of this contractor and bank employee (should be ex-employee) as miserable as possible.
