I just got my Experian CR. This company, United Recovery Systems did five seperate inquiries - 10/11/07; 12/08/07; 02/26/08, 09/04/06 and 01/03/09. Is that legal? they wrote it was for collection purposes? I was going to send them a letter asking them to remove it. Is this legal to do that many? United REcovery is not listed on my CR either. It was for Dell, I got behind but made good on my payments.
I found a sample letter on this website but it sounds very harsh and threatens to sue if they don't remove the inquiry from my credit report.
The forums here confused me. Some say any CA can do that. I am concerned about the amount, five times?
Any help would be appreciated.
We all have opinions on whether a CA has permissible purpose. The FCRA clearly makes mention that CAs can pull an inquiry. While the Pintos opinion makes mention that they cannot. I'm on the CAs have PP bandwagon, myself.
While I support a CA's right to pull a report, I don't support the right to pull over and over. IMO, they crossed the line, but the legality of it is certainly up for debate. And if you paid the debt in full prior to the last inquiry, then they don't have PP.
Only one of those inquiries, the one from January, is hurting your score.
The letter you found is a non-PP letter. If you want the inquiry off, then send it and follow through with the threat, if necessary. Only send the letter if you don't have a debt to Dell or you have no dealings with this CA.
Question: do you still have an inquiry showing from 2006?
Thanks for your response. United Recovery is a CA for Dell. I got back on track with Dell recently.
I must have made a typo on the dates UR pulled my report - they are again, in most recent : 01/03/09; 09/04/08
02/06/08 12/08/07and 10/11/07 in each case they have a note stating they are on record for 11/09' 01/2010, 023/2010, 10/10,02/211 -
I still owe the money to Dell, but i am making payments again. I never paid the CA.
Thanks so much.
I am positive I am paying Dell directly and not the CA.I don't have this particular CA listed on my CR.
I think it was abusive for United Recoveries to pull my CR that many times. Another CR pulled it, but only once. I would like to send them the non pp letter, but the language seems so very harsh and threatens to sue, and to be honest, I don't know if that would hold up in a court of law, because they might have the right. United Recoveries could also just trash my letter and not respond to it. Seems like it would be extra work for them.
