I just pulled my TU credit report from Myfico and I saw that StuartAllen and assoc. who I payed a chargedback commission to in early january
pulled my credit score on DEC 8, 2010.
they are a collection company for insurance companies.
it showed as a credit inquiry on my CR from TU.
It says it was affecting my score or may be affected my score.
I didn't give them the right to do so. is that legal for them to do so? and how can i tell if it was a hard or soft pull?
thanks in advance for your help.
There's plenty of debate as to whether or not a CA was permissible purpose, but, IMO, the FCRA is pretty clear that CAs can run your report.
If you pulled your TU FICO report, then it is a hard inquiry. You can only see TU softs if you pull your full report from annualcreditreport.com or directly from transunion.com.
What is a charged back commission?
One of the annuity companies I worked for paid me an $8,000 commission.
the gentleman passed away 9 months into the contract.
Oftentimes, annuity companies will charge you back commissions within the first year if the client dies within that time.
they didn't pay the beneficiaries until after the 12th month, so they held onto the funds past the point where they charge back (1yr).
plus, the company had cancelled my contract with them 4 months prior. so I wasn't even an agent for them anymore.
I've battled these points with them, until they placed this with stuart allan and forced my hand to pay it or have it hit my CR.
I've been working hard to see my scores go from 424 to over 620 now...and once i get my utilizations down fico scoring says I should be 672-722.
I just don't like the fact stuart allan appears as a hard pull on my CR.
btw, do i understand the previous post that if I use myfico.com to check my TU score it counts as a hard pull? if so, i won't use this site anymore to check it.

No....you were asking about whether or not it was a hard or soft inquiry. The FICO reports show only hard inquiries. I was saying that if you pulled your TU FICO and saw Stuart Allen on there, then the Stuart Allen inquiry would definitely be a hard pull.
Pulling your reports from myFICO (or virtually anywhere else) will not result in a hard pull and won't hurt your scores.
thanks, I misunderstood what was being said.
I thought checking my own score was a soft pull.
Still, does Stuart Allan have the right to make a hard pull on my account without my consent?
Was this done before or after you paid them?
And yeah, if the account was placed in collections with them, they do have the right to pull your credit as well as report it on your cr, even if you have paid it.
