need help ASAP!

After many attemtps to PFD to West Asset Management (Sprint) with no reply, I called to verify that I was mailing to the proper address- which I was. I was told that they will not do a PFD that is why they did not reply. She said that the best way to remove the Sprint collection from my account was to pay the bill and they will send a letter to me and the original creditor (Sprint) a letter stating that the account was paid in full and ask for them to remove it. I was told they are 3rd party billing and that they cannot remove the account from the credit report..only state that it was paid. But I am weary of trusting them...afterall they ARE a collection agency..lol!
 My dilemma is this.......are they lying to me about the fact that they are 3rd party and do not have the ability to remove it from the credit report? Also...has anyone ever tried paying the account without the PFD letter signed and had it removed from the credit report? It's only $303.00 but I want it removed...but not enough to throw away my money either...I'm so confused!

Have you ever DV'd West Asset?  Have you called Sprint and do they still own the account?

yes...I did DV West Asset and I got nowhere with that...so i went for the PFD. I called Sprint this am- they stated they didn't own the account any longer.

What do you mean you got nowhere with the DV? What was their response?

it was my account...and they sent everything to verify it. They sent me the last bill and my contract for my cell phone with all the needed fees for early cancellation, My signature to the service,  as well as a summarized version of our last conversation where I told them where to stick the bill and that I refused to pay it.  Unfortuantely they kept that part...LOL
what else can I do from here?

It's fine that it is your account. The purpose of a DV, from how I see things, is that it establishes who has the right to collect the bill from you. Does WAM have the legal right to collect from you is what you are trying to establish through a DV. You certainly don't want to pay the wrong people correct? What if you pay WAM and then find out that they don't OWN the debt and you then have to pay someone else $300? You would have a heck of a time getting your $300 back from WAM, I would bet.

Send this DV, stating that the other validation was incomplete. Give 'em the full 30 days to respond. Send it CMRRR and do not sign name.

To Whom It May Concern:
This letter is being sent to you in response to a notice sent to me on DATE. Be advised that this is a notice sent pursuant to the Fair Debt Collection Practices Act, 15 USC 1692g Sec. 809 (b) that your claim is disputed and validation is requested.

This is NOT a request for “verification” or proof of my mailing address, but a request for FULL MEDIA VALIDATION made pursuant to the above named Title and Section. I respectfully request that your offices provide me with competent evidence that (a) the account is valid, (b) the amount allegedly owed is accurate, and (c) I have a contractual obligation to pay Debt Collection Company Name for this alleged debt.

All of the following MUST be provided to adequately validate the authenticity of the alleged debt AND provide proof of my contractual obligation to Debt Collection Company Name for this alleged debt:

• Signed credit application between myself and the original creditor
• Copies of all signed vouchers from the date account was opened until default
• Copies of all statements from the date account opened until default
• Proof of the statute of limitations
• Proof of agreement that you were hired by the Original creditor (creditor as defined by the FDCPA) or
• A copy of the contract Debt Collection Company Name purchased the alleged debt.
• If the alleged debt was purchased, provide a copy of an agreement between Debt Collection Company Name and myself, signed by me, stating that I have a contractual responsibility to Debt Collection Company Name for the alleged debt
• Provide proof that Debt Collection Company Name is bonded/Licensed for debt collecting in the State of Your State

Be advised that failing to provide ALL of the media requested to validate the alleged debt will invalidate any and all claims Debt Collection Company Name is asserting regarding this alleged debt. If Debt Collection Company Name can NOT provide all of the validation media requested above, ALL collection efforts MUST be stopped and the account MUST be DELETED from the Debt Collection Company Name. If you can NOT validate your claim, you can NOT, by law, collect on it, or SELL it to another collection agency. Also, reporting a debt to the credit reporting agencies that can not be validated is a violation of the FCRA (Fair Credit Reporting Act), and carries a $2500 fine to be paid to me. I have two years to decide if I want to pursue this matter. PLEASE GIVE THIS MATTER THE ATTENTION IT DESERVES.

If your offices are able to provide all of the validating media as requested, I will require at least 30 days to investigate this information, and during such time, all collection activity must cease and desist.

I am also stating, in writing, that no telephone contact be made by your offices. If your offices attempt telephone communication with me, including but not limited to computer generated calls and calls or correspondence sent to or with any third parties, it will be considered harassment, and I will have no choice but to file suit. All future communications with me MUST be done in writing and sent to the address noted in this letter by United States Postal Service.

Thanks for the reply!
ok..i will give it a try and resend the DV letter. With any luck they will screw up in some way that I can have this removed.  If it comes back validated to be mine....then what? Should I trust west asset to "help" me with Sprint to have it removed? Or would I still be wasting my time and money?

Whatever they promise, get it in writing. I would never trust a CA. By nature, they seem to be untrustworthy.

If they are able to perform the full media validation, (BTW, don't change any of what you are asking them to provide), then the PFD is the next step.

I know you already DV'd, but what is SOL for your state?

I got West Asset to go away when I disputed via the CRAs. They deleted it immediately. It also was for a Sprint acct. Reason for dispute was amount due. Their balance did not match mine.
