quick question

as of right now im getting ready to send off some pfd and gw letters. my question is do i send the funds now ir i wait itl i get a response. i know i know im trying to read through all this good info.the hubby and i are determined that this is our yr to get things back in shape!!! wish us luck!!! thanks!

Don't send any money until you get an agreement in writing.
 
Have you DV'd? Are you within SOL?

umm well i know the debt is mine because its not from that long ago. its a unpaid telephone bill for $59 that i just want to take care of and cable bill from cox in california. i now live in va. im still trying to understand the sol thing.

SOL protects you from being successfully sued over debt after a specified time has expired. Of course it only protects you if you appear in court and use "past SOL" as your defense.
 
A creditor can sue at any time, just when it is past SOL, you have a defense and they won't win.
 
A DV isn't just sent to prove the debt is yours, but that the CA has the RIGHT to collect the debt and ABLE to collect the debt. Many CA's still remain on CRs even after they no longer own the debt. But I'm sure some of them would have no problem accepting payment.
 
If the debt is not with a CA, then ignore the statement above.
 
I have a few that I sent PFD before DV'ing. Mine were really small, as yours are.
 
You DON"T have to send a DV first, personal choice.
 
But I would not send payment until you have something in writing. Also, if these are with a CA- have you talked to OC? Sorry, dont' remember if you mentioned in the original post if they were with a CA or the OC.

ohhhhhhhhhhh ok im getting it. they are actually with a ca and no i havent talked to the oc. should i talk to them first. its with cox ommunications.

I would contact the OC and explain that you moved and thought you had taken care of any remaining balances and due to the move you didn't receive anything.
 
Tell the OC you just found out about the balance when you pulled your CR and ask if they will "pull back from the CA" and allow you to pay them directly.

I just wrote a letter to Cox Communications yesterday...I have two collections with them...one for cable $135...and one phone bill $57...and I explained I moved to another state and didn't receive anything regarding the bill...and asked them to pull back from the CA if I pay in full...
