Comenity Sold Debt to Midland

I had a Virgin America Visa that charged off in 2017 - Sold to Midland in March 2018.  Got the letter that from midland and from comenity that the debt is sold and now belongs to midland not comenity.

 

I got notice today that Dec 2018 - the debt has been recalled and back with comenity???   They can do that?     Why would they do that?

 

I have other cards with comenity they did not sell off ....

It’s not uncommon to be called back. Especially when consumer is trying to settle with lender in GF. If you haven’t contacted lender, a very good question.

When a creditor has sold the debt, they no longer have legal ownership over the debt, and cannot "recall" the debt.

They would need to re-purchase the debt that they have already transferred ownership of, which is rarely if ever done.

 

It is more likely that the creditor only assigned collection authority to the debt collector, which they can terminate, as they always retained ownership.

Are you positive that the debt collector actually purchased the debt,and then sold it back to the same creditor who they acquired it from, or did the debt collector only have assigned collection authority?

This shows the debt was SOLD to midland in march

 

and in December it was recalled

 

What reason would the have to recall the debt

Did Midland ever end up on your reports?  If so, that letter should remove it.  Very strange.  Maybe Comenty was unhappy with MCM or something was not done correctly and actually paid for.

 

Now to search Atlantic Credit and Finance...  DC or JDB?

@OP did you claim that account was fraudulently opened or not yours to midland or comenity?

No I did not.    I havent talked to comenity or Midland at all since i defaulted. 

 

I actually went on a payment plan before defaulting... to keep it current...but i ended up defaulting on that...then it charged off.

 

I have other accounts that charged off with comenity that they did NOT sell. 

Think they recalled it so they can sue collectivly?

Update:

 

Well i filed CH7 in Jan... included this account for 4K

 

I received a letter from comenity TODAY....with a CHECK for $400 from comenity...

 

Looks like they went thru some sort of audit and came to the conclusion they overcharged me somewhere with interest i guess...

Must have been something to do with selling the portfolio or something...   That is why they recalled it from midland.

 

If you have a Virgin America account... you may be getting a check...
