Help Debt Validation Issue

Hi All,

 

I have been having the hardest time getting appropriate debt validation information from a collection agency. They are reporting to my Experian report a deliquient bill of $725 original creditor National Grid. I sent them a debt validation letter about two months ago and they sent me back a one page print out of a bill, I assume it's the final gas bill for a address I lived at in 2005-2006. The bill dated June 5, 2006 simply says, Previous Balance $689, Current Charges $36. Nothing more. I know I never ran up a bill that high at that address, I've never even had a total gas usage of over $700 for a whole year! I cannot fathom that those charges are correct and I have no recollection of ever having a past due gas bill from that address. So I sent them a second debt validation letter about 2 weeks ago reminding them of what is required to meet their burden for debt validation, and asking for an explanation of the past due balance. Yesterday they sent me a response, it was the EXACT SAME bill, but this time they highlighted the balance due! I am so aggrevated! I have no idea how the balance is that high, and we are very close to the statute of limitations in my state (6 years), so I want to find out the date they "claim" I first became past due. I'm sensitive to the fact that if I'm too aggressive it could have unintended consequences, like them filing a lawsuit, but at the same time I'm extremely annoyed that they have failed to provide suffucient documentation of the debt to satisfy their burden. Any advice on how I should proceed would be greatly appreciated!

I'd call the OC and ask them about the bill if you disagree with the CA's DV reply. If the OC says the same and you do agree, then send a PFD to the CA. If you disagree, then work the balance out with the OC. If you know you did owe $$$ to the OC, then another step to take would be to offer a PFD to the CA on a letter amount based on what you think you owe and see if they accept, but I would contact the OC first.

 

To find when you first went delinquent, pull your reports directly from the CRAs or annualcreditreport. EQ will list the DOFD. TU and EX will list the drop off date and you can subtract 7 years from that to get a rough DOFD.

When did you move from that place?

 

Did you call to turn OFF the utilities?   Not transfer them to someone else's name, but actually turn them off?   Did you receive your final bill AFTER you moved out?

 

** saying you are moving is not always enough to close out your account, especially if  no one comes along behind you to put the utilities in their name.

** turning them OFF helps prevent the final bill from being too high.   Here, if you turn OFF the utilities cuz you are moving, you are still responsible for the monthly costs for the privledge of having that service (costs $10-20 account fees per month) monthly until someone comes alongs and puts the bill in their name.

** the final bill can be generated up to a month after you close the account.

 

When we moved, I called and cancelled the service, and asked them to turn OFF the utilities.   They said sure, but you know you have to pay until someone else comes along and says they will pay.   The new tenant couldn't be bothered with putting the bills in her name.  That created an issue.  Smiley Sad

 

The bright side is most companies will now go after the owner of the property, if you are renting and tell them you are renting when you open the account in your name, and the bill will revert back to the owner.  And if you sold the property, make sure you tell them you sold and who will be calling to set up a new account.

Thanks for your advice llecs! Couple of issues with that solution. 1st the OC has been acquired by National Grid, the OC was a small local gas company that no longer exists and National Grid was unable to provide me with the information you mentioned. I vehimantly disagree with the amount, there is no way I could possibly owe that much and I can't imagine I'd owe more than $100, I'm not sure the CA would accept that on a $700+ balance. Clearly the CA has reaged this account, it only shows up on my Experian report and it does not show a DOFD but notes the drop off date as July 2017, which is impossible because even the one page document they show reflects a date of 6/5/2006. I'm considering filing a formal complaint against them with the AG office in my state, my state clearly requires "A creditor must allow you or your attorney to inspect any document on which the creditor is relying to prove that you owe the debt being collected, e.g., a credit card application, account statement, promissory note, ledger, account card, or similar record in the creditor’s possession, which reflects the date and amount of payments, Fair Debt Collection Page 2 of 2, Rev. 10/2007 credits and charges related to the debt. Failure to do so is an unfair or deceptive act or practice under the Attorney General’s Debt Collection Regulations" They have not provided this and what they have provided me CLEARLY shows they reaged the account.

Thanks, I moved from this location on 5/31/06 and I did shut off the utilities. The statement they gave me is dated 6/5/2006 and reflects it as a final bill and the amount is in-line with what I'd expect ($35). The previous balance amount of $689 is what I'm questioning. Also of note, I have an old copy of my experian report from last January and it reflects the same account with the same collection agency and a much lower balance. I also have the original collection letter on the account which is a much lower number, it almost looks like the CA is going in and manipulating the bill statement they are sending me.
