Help With USBank Account Reporting Incorrectly

I'm trying to make sure my CR's are totally cleaned up and came across this account.  It is reporting as a negative account and NEVER should have been - the account is only reporting on TU.

 

 

Last Reported:  Aug 31, 2011

Creditor Name:  US Bank

Account Type:   Credit Card

Open Date:  Jun 01, 2006

Closed Date:  Jul 01, 2008

Remarks:  Chapter 7 bankruptcy

 

My chapter 7 was filed in August 2013.  This account was CLOSED in good standing 5 years BEFORE my chapter 7 was filed.  Why would I have the negative ch7 remarks be on this account if it was a closed, in good standing account?

 

Do I dispute to get the incorrect negative remarks removed or dispute because the so-called negative account has been closed over 7 years.  My TU report doesn't have the expected falloff date until 2018.  Who do I start with TU or USBANK (grrrr).

Yes, get it corrected.

It is currently telling anyone reviewing your credit report that you had a prior debt discharged, not by your payment of the debt, but by BK

Thus, it is stating that the creditor took a loss.

It looks like a no-brainer in getting corrected..........

 

I would dispute via the CRA, who will then refer to the creditor for their investigation and response back to the CRA.

You can choose to alternately file a direct dispute with the credtior, bypassing the CRA.  Your option.

 

Credit report exclusion for the BK is ten years, so I would not wait for exclusion to remove reference to the BK.

You would not dispute based on credit report exclusion having expired.

Thank you! I'll give them a call on Monday.

What about accounts that were closed by the creditor because of bankruptcy but there was a 0 balance on them - can those say ch7?

I have a Macy's that was never late, always PIF but I think they closed it in May 2014 prior to the bk even being filed because I was in default of my Macy's Amex - that one reports as a derog, ch7 account too. That's a derog on all 3 reports.

I don't have a copy of the filing (I moved states, who knows what I did with it). But I just took a look and I have the trustees report that lists the Macy's Amex claim as allowable secured debt but the Macy's store card is not listed (no balance) anywhere.

The letter from them says they closed both cards on the same date, about a week after I filed.

I called TU this morning, spoke to a nice guy - sent the dispute in for the USBank account.  I'm confident that one will get fixed since the account was closed 5 years before filing.  Even the CSR saw the errors of USBANK's way on this, lol!   "Ohhhh.  yeah.  I see"

 

I asked him about the Macys (store) account - since it was closed by them with a $0 balance when I filed on the Macys AMEX and they held both accounts,  It was was never late AND it was not included on the trustee's list in any of the documents that were mailed to me.  He disputed that one too - I know it's a longshot on getting that changed so I'll see what they respond with.  Otherwise the information reported is accurate so that was the only way I'd get it off anyway.

 

And the 30 day clock starts ticking....

Just be aware that with an account that old, USBank may simply choose to delete it rather than try to verify it. I had that happen with one of my old accounts.

That's what I figured might happen.  I'd rather have the negative remarks and/or account gone than have it inflating my AAoA - I have enough old, positive accounts holding that up while I'm rebuilding.  I have no idea how it got updated/changed when the last updated date on my reports is from 3/2011 - it's a strange one for sure.
