This is what I would do. Write a short letter to the OC and include the account number and the DOS (date of service), along with a cashier's check for the full amount using the restrictive endorsement. Send it CMRR.

 

Have a folder containg everything and anything pertaining to this debt. Have hard copies of your credit reports that shows this collection in not on them.

 

Can the CA report the collection after it's been paid? Yes, anything is possible! But they are not supposed to and it is because they no longer have a BP to. This is why I want you to keep a hard copy of your reports showing there is no collection.

Oh my goodness.  Yet another question.  Seems as soon as I get one answered and on my way to solving the problem, 5 more questions and problems present themselves. 

 

I was about to draft a letter to send to the OC but I do not have the address.  So I googled the number that I called earlier.  (By the way, if you notice I did not have any contact info on the OC until I received the collection notice that they were collecting on behalf of Temple Emergency Physicians...then user Let gave me the number he used) They did in fact have my information...

 

Anyway, not to drag this on, but when I googled the number, it is not to Temple Emergency Physicians, it is for a business called TERM Billing, INC.  They are a billing service!!!!  The number I used was 800-474-8376.

 

Now what?

Now you're asking a lot. JK!Smiley Happy A very simple letter with your letterhead. At the top the letter type the account# and DOS. In the "RE" Payment in full for account# xxxxxxxxxxxxxxx

 

To whom this may concern:

 

Enclosed is payment in full for the above-captioned account. Should you have any questions, please call me at xxx-xxxx.

 

Send the letter CMRR and do not mention collections, a CA, or HIPAA in the letter. Also take note, when payments are sent to the OC using a restrictive endorsement, sometimes it can take a long time for the check to be cashed. Remember to photo copy the letter and both sides of the check and keep these in the folder I discussed. Save the green card too. Don't forget to write the account# in the memo too. Hopefully, the check gets paid and you're done with it. Let us know what happens.

Act like an ordinary Joe or Mary and call the OC and ask where payments are mailed to. Don't talk about anything else with them.

sorry sccrgirltx, (about giving you that number!, that was all i could get as well)  so do I not send the HIPPA letter to that company?? I am so lost!!! If they are a billing company then do I find out who the DR was and send it to him or her??

I did that, just said that I had a couple of questions.  A supervisor told me that when people send payments to them that are already in collection, they just simply send them over to the collection agency.

Let, no worries about the number! At least I know that they are a billing company.  I actually did call back and asked the lady for the contact information for Temple Emergency Physicians, and she said they were them.  I said, umm...NO...you are Term Billing Inc.  LOL.  She then said that there are several different groups that bill from there.  I know, it does NOT make sense.  As soon as I seem to be getting closer and closer to the answer.....I feel like an avalanche falls back on top of me.  I can see why people hire people to take care of this!!!  Between work and kids it is driving me crazy. 

 

This is what I am going to do.  I am going to try what Fuse suggested and send a letter to that place along with the restrictive endorsement on the check and pray they cash it!!!!

 

IF that doesnt work, my next step will be will be to write a letter to the collection company stating that I was never sent a bill, etc, etc (which is the truth) but that I was willing to pay the full amount if they agree not to report it to any and all CRA's and that once I receive a letter from them on a company letterhead agreeing to the above terms that I will send them a money order immediately, etc, etc.

 

Let me know what you do, and what results you have.  I'll keep you posted as well!

I don't think this is a good idea. There's a reason why it's not on your reports, we just don't know why. Go with the OC plan and see what happens.
