Good morning!. My son has several acoounts with Comenity Bank. Either myself or my son pay his CC bills faithfully thru my bank or his bank which is NFCU. Ok his express card payment got returned and we wasnt aware of it until a representive called saying his account was ALMOST two months behind. So my son paid the bill and come to find out that pament was returned. so we called Comenity to see what the problem was and she said that it was returned. But the money was in the account. I'm thinking it has to be a glitch in their system because once my son paid the bill , on his checking transaction the payment was pending. So to make a long story short my son now has a 60 day late, score drop 50 points and we are devastated. Has anyone had any success with getting lates remove? And if so, who did you contact to get it removed?
I haven't had experience with it, but this is 100% THEIR fault, if it was me I would be calling everyday telling them that it is their fault and would not stop calling until they took that mark off my report that shouldn't have been there in the first place.
They confirmed that the payment was returned for no reason, right? So, why is this even an issue? Just call and keep asking for someone higher up everytime they say they can't do anything.

Is the Comenity account a revolving account or a loan?
If revolving, you have acess to the dispute process under the Fair Credit Billing Act (FCBA), which provides for dispute of any billing-realted matter on a revolving account, and has additional benefits and requirements not afforded under the FCRA dispute process.
Regardless of whether you use the FCBA or FCRA dispute process, you have an asserttion that there was no default in payment,and thus no delinquency.
A dispute of their credit reporting under the FCRA would additionally require that payment was not accepted by them until at least 90 days after the billing due date in order to support a 60-late. When did they finally accept and post payment?
Its a revolver. They accepted the payment yesterday. So technically its on 30 days late. But that brought down my sons credit score 50 pts
Then I would file an FCBA dispute of the non-accpetance ot the payment, which mandates posting on the date recevied or the next day, depending upon time of receipt.
If the FCBA dispute is successfully resolved, then the reporting of being more than 30 days past the billing due date would also be inaccurate, leading to deletion of that reporting.
