Question about same name judgments

I’m hoping someone could assist me point me in the right direction with a question I have regarding judgements.

Long story short, my father and I share the same name. (Jr and III) While living at the same address when I was younger, I had judgments placed against me. I have since moved out and am working to pay these judgments back, however, when my parents decide to sell their house and retire will they have an issue as far as title companies holding them up because of the judgments against me? The judgments themselves don’t specify JR or III and it was a problem a while back when they tried to levy his bank account instead of mine because of a name and address match. They failed to match the SSN. It took a few weeks to get that sorted out.

I’m just trying to figure out what preventative measures I can help take, along with paying back my debts ahead of time so when they go to sell their house it doesn’t get held up at all.

Will this be an issue? Or will the title company do sort that out when it gets to be time to sell? I would appreciate any help with this. Thank you

Re: Question about same name judgments

Depends on the bank. I was denied a Sears card when I was first starting out because almost all my info matched my dad's. First name didn't match though. Regardless, I was denied for a bankruptcy on my report. I had never filed bankruptcy, but my dad did. Tried to call the bank to explain, but they would not even talk to me because they believed they were right. Not sure how you can get ahead of it, but if you can, do it.

Re: Question about same name judgments

The title company will perform a public records search and there is a chance this judgment would pop up.  If it pops up, your parents would state it doesn't belong to them, and the title company will have them complete a "Statement of Information" that details the past 10 years of their lives (where they've lived, any names they've used, and other information like that).  The title company will then use that information to confirm the judgment does not belong to them.  Any information that you have which confirms it belongs to you could also expedite the research process by the title company.

You're welcome, hope it doesn't become an issue but if it does at least you know what to expect.
