SOL question

SOL in Tennessee is 6 years. Not sure if there are any particulars for Tennessee, but I have a case with DOFD 7-2002 that process server attempted to serve to me but I was not home. Attempted serve date is July 2007. Now the court website simply shows Alias NTBF(Alias not to be found). They never came back and did not make any effort to get in touch by phone or mail. Gault Financial is the CA and I don't know of any account it could be associated with. Quite frankly, there have been 2 or 3 CA entries on my reports that are bogus and have been removed after a DV. So this SOL should run on 7-2008? There is no effect of them attemting to serve me while the debt was within statute? Your thoughts and comments are appreciated

It is within statue..and they are attempting to serve you...it would be past SOL at the end of July...

They filed suit within SOL. When they find you to serve you, I doubt you will be able to claim "past SOL", even if it is, since they filed within SOL.

So they filed within SOL and even though they did not serve me...the filing of the complaint with the court suspends the SOL? Correct Does it reset it?

You posted in your first post..that the processor attempted to serve you...but you were not home...you acknowledge their attempts to serve you...did they leave some sort of letter at you door...

I live in a smaller town and they made only one attempt. Eventually it went back into the court system as alias NTBF. Same office came out and served me on a different case about 6 months later. 3 cases in the system against me now. The first was bogus and they went away with a DV from my atty ( I have had MORE than my share of identity theft and accounts that were not mine on my report - currently 3 out 5 baddies on my CR) I called the proc serv guy back on the other two and had him re serve. They simply never attempted redelivery on this one they missed.
