Now you send the email to the CEO and COO of Midland/Encore Group and state the facts..\

 

You sent me a dunning notice and you were on my credit..

 

I sent you a DV Letter....

 

You did not verify the debt and only sent me letter asking for some documentation from me...not sure why as I don't work for you and you need to provide me with proof of debt.

 

You deleted my trade line from all 3 credit reporting agencies.

 

Now I see they re-appeared again but I still don't have any debt validation.

 

 

You have 5 business days to explain this to me or send me debt verification. If you have not I will file a suit for FCDPA Violation...asking $1000 maximum for damages for :

 

a) pursuing collection activities without verifying debt.

 

Please have someone contact me ASAP or delete my trade lines by __/__/____

Awash, The only response from them after receiving a DV is a validation or a deletion. Responding to your DV with a request is not acceptable under the law. It also stopped their thirty days from ticking. Take a copy of the letter that the ca sent you, send it CMRRR to the cb's. Advise them that the ca did not respond properly and demand the TL be deleted. Good luck.

Thanks everyone. I fired off an email to some of the Execs at MCM, and will also be sending a letter to each of the CRAs regarding this matter.

So I sent an email to the CEO and received the following response:

"Midland Credit Management Inc. (MCM) has recently received an inquiry and/or request for information from this e-mail address. It is MCM's policy not to respond to inquiries of this type through e-mail to protect the privacy of those we do business with. If you intended to communicate with MCM, and would like to discuss the matters raised in the prior e-mail, please contact me at 1-800-825-8131 extension edited between the hours of 9:00 a.m. and 4:00 p.m. Pacific Standard Time and I will be happy to discuss the matter with you."

CRA Disputes with all documentation will be mailed tomorrow. Any other advice??

Send back an email to the person who emailed you this and let them know that at this time because they have violated FDCPA and basically broke the law you do not wish to contact via phone as every contact you will make from now needs to be in writing since you are planning to file a lawsuit. Let them know that they now have 4 business days to send you a Debt Verification letter to your address via US Mail.

 

When you sent the original DV letter...did you do it via CMRRR or did you just send it out regular mail? If you sent it via CMRRR and have a copy of a green card...scan it and attach in the email..let them know that you did your due dilligance, you don't work for them so you won't do anything else besides having sent the DV. Highlight the fact they received it and who signed for it and once again ask for proof...

 

4 business days left before I will pursue legal action.

My situation is almost identical except they are saying my OC is Verizon. not sure if they are talking about residential or wireless but either way this is not my debt.  The stated delinquency on my reports is $1083.  I was preparing to apply for a mortgage when I noticed the collection on my reports.  So I disputed on 11/19/11 thru all 3 CRA's.  The disputes are all pending. I sent them a DV thru CMRRR and received the grren card receipt today, as well as a letter from Midland identical to yours.  They received the letter of DV on 11/28 so I guess I will wait 30 days then send letters with all copies of communication (copies of DV letter, CMRRR receipt and copies of the letter they sent me asking to validate the debt for them). I will also send a letter to midland saying if they dont delete immediately then i will file suit. And I WILL file suit.  I really dont wanna screw around with this any longer than I have to.  Hope I'm doing this right.

Same thing just happened to me. I DV Midland they removed it from Exp and TU but not EQ they just reported a 0 balance. They sent another dunning. I DV again they responded with a request for documentation and updated EQ to the original balance of $1090.

What should I do now?

Follow the directions of the other posters( re this same situation) to a tee Dont give information other than name and address.Good luyck
