Wife's judgment removal questions

NATIONWIDE MUTUAL INS

2760.00 bal only $945 left I have been paying it off monthly if not they suspend her license.  Already done it twice.  Shows on ex and tu

can I get this removed after its paid off?

 

Talked to lawyer and they said

if I pay it $945 left without interest  they will order it as paid satisfaction and it will be removed but that's no a motion to vacate is it.  Not trying to lump sum it if I can't get it completely removed

Upon what are you basing your "and it will be removed" conclusion?

 

If the judgment creditor is the party who reported the judgement to the CRA, and they have promised to report its deletion, then yes, it will be deleted.

 

However, payment itself does not result in deletion of the prior reporting.  It is often the case that judgments, being public records, are discovered and reported by third parties, and not necessarily the judgment creditor.  In that event, the judgment creditor would have no authority to delete the reporting made by another.

 

Two paths. 

Some courts will entertain motions to actually vacate their prior judgment upon payment of the debt, while others wont.  Check with the judgment court as to their policy.  If vacated, the reporting party would then be required to update their reporting, deleting the fact of a judgment.

If you cant get the judgment vacated, then you must turn to the party who furnished the reporting, and get their GW deletion of their own reporting.

the lawer I make the payments to every month is who said that they will enter a order of satisfaction. and that it will be removed.  it lists nationwide insurance and the court info on the credit report though.  lol right again shogun

The lawyer is the one you'd have to go through to have it vacated.  So yes.. I believe this is a good thing.
