a few questions

1) how do I go to a oc about a debt? Do I contact them and ask them to pull the debt from collections and offer to pay them for doing so? Do I need to get a letter from them , stating that they will pull it from the ca before I pay them?
 
The following happened during a divorce and long custody battle
 
2) I have a old car loan (citi)  that is listed on my credit report. The loan was sold to midland credit. The oc (citi)  is showing it on my report as oweing nothing, $0 balance but as a repo. Should I dispute this with the cra and see if they will remove it , since it was sold to midland credit? I have made a 75 dollar a month deal with midland , if they will ever send a agreement, for some reason I keep asking for them to send the agreement in writing and they only send a bill for payment if full.
 
3) I have a old mortgage showing as well as oweing $53,669 as a charge off on my exp and tu reports but on my equifax it is showing paid off with a $0 balance. I believe they resold the home but I havnt done a drive by the house yet to find out. Would it be wise to do a drive by the home and make sure it was sold and then dispute it with the cra for a incorrect balance? Maybe even send a copy of my equifax report to the other cra's?  I just dont want to wake a sleeping dog if it wont do any good. The oc was conseco and I believe green tree purchased conseco. Here is the other part that might help,
On my equifax which list it as a $0 balance it is posted by green tree ,
On my experian which list it as a $53,669 balance it is posted by green tree
But on my Transunion which it list as $53,669 it still shows Conseco

Also I should add that the car loan is about 2 years old and the mortgage is about 5 years old

First never file a dispute with the CRAs on a debt that the reporting is accurate!  This would be credit repair and is not allowed on this forum!

                               When an OC is reporting  a CO (collection) with a Bal $0
                               This usually means that they sold the debt & can report up untill CRTP (7 7-5 years from DOFD.
                               1 good reason NOT to dispute.....it usually comes back verified & if they haven't reported in awhile....the CRA will up date and may cause your scores to go down. You want the report date to age!
                              The best way is to send a GW letter....The can not accept payment as they do NOT own the debt!
 
You can have 1 OC and 1 CA reporting the same debt!
 
When dealing with a CA......never talk to them   never sign anything going to them!!!    Always send a DV  CMRRR   before thinking about a PFD.   You are in a better postition offering a PFD if past SOL.
 
Remember If not past SOL a creditor or a CA may file a lawsuit for the complete amount!
 
Sometimes it is best to wait to be past SOL. and then send a DV & when answered  then send a PFD
 
Know your SOL
 
SOL is set by the states. It means the time limit in which they can file a lawsuit & win.
                       SOL in many states is reset when any payment is made.

                    Did you start making payments?    Look at your CR for the drop date    will remain on my CR until  month/date.  Or call the CRAs and ask....do not file a dispute!!!!    The OC reporting Bal $0 is correct!      Send them GW letters

                      Mortgage companies usually report under Public Record *foreclosure*  I have never heard them reported as a CO.
   
 I am unsure how to handle this.       You will get someone in here that might be able to answer you about this   IF not  post just this question about the mortgage on the * mortgage thread*

I was not refering to disputing this debt  when I asked this :

1) I was asking about a debt that I do owe. I was asking about how to go about having the oc pull it from the collection agency and pay the oc instead of the collection agency thus it being removed from my credit report as the oc isnt reporting it, only the ca is reporting it.
 
On the car loan which is reporting $0 balance with citi . Send them a GW letter and just hope they will remove the repo from my report ? correct ?
 
As far as the mortgage , I did as you requested and posted it in the other forum with some update info and I also did a drive by the house today and it was indeed sold
Funny thing is I only owed $53,669 when I left the home so considering it was sold I know the amount can not be correct
It also isnt reported as a collection , it is reported under accounts as a $53,669 charge off on experian and transunion

If the debt was SOLD (not assigned) to a CA........You can not go through the OC!!!
 
Once the debt is sold   the OC can still report it up till the CRTP.  You can only send then GW letters
 
The CA would own the account & only they can accept payment!!!
 
An OC can only pull a debt from a CA if the OC owns the debt & only assigned it to the CA to collect!

You would send the CA a DV   CMRRR       they have 30 days to answer OR stop reporting.

I did this and they sent me a form that they created off their computers that list the oc and amount , nothing else. they never disclosed if they own or are collecdting on assignment, even though I asked this. I also asked for accounting history and a signed contract . I got nothing from them accept a name of the oc and a amount

This is on the repo  correct?        when did the repo the car?     what state are you in & what state when you bought the car if different?
 
I want the dates from the OC report or from your memory..........not just the CA

when i was refering to going to the oc instead of the ca , I was refering to a old gas bill from consumers energy hoping to get them to pull it from the ca and pay them thus it would be removed from my credit report as the oc isnt reporting. but as I stated above , I dont know who owns the debt or if it is being done on assignment

The best dates I can give you are from my credit report
Equifax shows :
Last activity april 2006
no close date
 
Transunion shows :
last activity feb 2006
Closed aug 2006
 
Experian shows :
last activity june 2008
last payment feb 2006
 
The feb 2006 sounds about right
 
These come from my credit reports list from citi auto, not the ca
