i have been dv with the cr for a couple years over this already as the cr when updating a old student loan created duplicate listings every time the amount owed changed instead of just updating the same account
all i ever get as a response is that they were able to verify the accounts and this time i was not so nice in demanding that the duplicates be removed because 3 years of trying to get duplicate accounts removed is rediculous
as far as contacting the oc i get nowhere because their excuse is that they do not choose how the cr decides to list accounts so it is being nobodys responsibility and one of the listings does not have a date to expect it to be removed on its own
the cr is making people think i have 20 student loans and all i ever had was one and everybody is giving all kinds of excuses to not do anything
i want these extra accounts removed and i want the cr to actually care about doing their job
DV with the CR? what do you mean by that? you don't DV a Credit Reporting Agency.
If you feel you have given the CRAs enough time to fix their mistakes, then you should send an ITS letter for the various violations of the FCRA (every incorrect reporting instance is a violation), and be prepared to sue them in Small Claims for the maximum amount in your jurisdiction. Either the ITS letter or the service gets their attention pretty quickly.
the cr keeps creating new listings every time a account updates and they keep creating accounts to the point that my actual debt in bills from the mailbox is reflecting as tens of thousnads of dollars more when you look at my cr
and since the oc insists that they have nothing to do with how the cr decides to list the account and all updates i am being passed to the cr all the time but the cr only responds with the accounts are verified so i have to make my cr understand the problem is with the cr creating new accounts instead of updating existing ones and admit that they are creating the new accounts by seperating the updates into appearing as more accounts
Send an ITS letter and follow through if they don't fix it.
i just found out what its means and i do not have thefinancial resources to sue
i am living on disability and that pays less than half of the poverty level and lawyers want such a high retainer that to pay the retainer means i have to lose my housing voucher for having too muchcash assets
so suing anyone is not realistic on my income so i guess i will have to do such insane things that will attract the attention of the news so i can put bad publicity on the cr
with news organizations they operate as
reasonable = completely ignored
more insane you act = more channels devoting time to your cause
i would like to be reasonable but at the same time you need to play by the rules set by the news
You can file in small claims court usually for less than $100.
Have you filed complaints with the BBB and AG regarding this situation?
for small claims court in south dakota you need to have a dollar amount that it cost you such as paying $500 to order a product and they never delivered and with only wrong data and i am not out any actual money by paying a fee to the cr then i have no cause to even file
the ag tells me that they do not do anything with errors on a cr and just tells me to to what i have been doing for the last few years
you need to remember about south dakota places even government offices deliberately come up with excuses not to enforce the law unless they are the victim
Small Claims courts can enforce statutory fine deriving from consumer protection statutes - these fines are kept to a minimum for a reason.
Every violation of the FCRA bears a statutory fine of $1,000 - sue for as many violations you want and ask for the maximum $12,000 amount if you can find enough violations.
The fee and court costs for filing a small claims action vary, depending on the amount of loss claimed and the number of defendants. These are paid by the plaintiff at the time of filing. These amounts may be changed by law, so the plaintiff should ask the clerk about the fees. SDCL 14-6-1, 15-39-52, 16-2-39.
