I'm not trying to say this wasn't my fault. All of my financial managing was done through me I was still able to pay my bills and automatic Bills pay was set up for all of my accounts before I left. The issue was I wasn't notified to pay this account or I would have. It wasn't that I was trying to duck my responsibility it was more in not knowing. It was my fault that I forgot to return the boxes to properly close the account. Although before being deployed I guess some thing's go by the wayside and you forget about it which was my mistake
With that being said I feel like the Debt Collector holds a little responsibility because I was not contacted. I wish I would have had the oppurtunity to rectify the situation on spot or work out some sort of deal to make things correct until I was able to return.
I deployed In July of 2013 the account became deliquent and was sold to ERC Septemeber of 2013 and charged off and put on my credit report Oct 2013. I returned March 2014 and payed my debt March 24th 2014.
I now have another EO working on my case calling the company to get them to remove the discrepancy's hopefully this goes as well as I think it will. Said his family is Military and he's really happy to try to get this fixed for me.
The issue is not validity of the report or the collection! OP admits it and PIF as he stated earlier.
The issue is at the time of his account being sent to collection, he was deployed for service duty. Therefore any attempt they made to contact him before reporting it to CBs, was not successful.
If he would had received that phone call, he would paid it.
By law in many states, they must notify consumers based on the contact info that they have, before reporting it as collection to CBs! even if they are Bills fan!!!
