Consequences of opt out

I am in the middle of the HIPPA process and I just received a response from Juniper about my request to opt out.  They cancelled my card.  What the crap, all I wanted to do was keep them from talking to other companies about my credit.  Can they do this?  Should I try and replace the card with another one or just let it lie? Thanks dP

They said since I rejected their terms or CIP they automatically closed the account. dP

I think they confused the opt out term, they thought since I didn't want them sharing my info with other companies I requested to cancel the card.  Weird huh! Oh well Juniper sucks anyway! Just my two cents, man am I ticked off! dP

OBTW this is what I wrote to them

 

1. I am asserting my rights under the Financial Services Modernization Act and the Fair Credit Reporting Act to "opt out" of the following two uses of my personal information:
a. You do not have permission to disclose personally identifiable information with your non-affiliated third-party companies or individuals.
b. You do not have permission to disclose my creditworthiness to any affiliate.

2. I am further instructing you:
a. Do not disclose any of my transaction and experience information to any affiliate of yours.
b. Do not disclose any information about me in connection with marketing agreements between you and any other company.

3. Please respond to me in writing stating that you will comply with these instructions. If I have not received a letter within thirty days specifically denying my instructions, I will assume your records have been noted to comply with this letter.

I am mailing this in a sealed envelope, and I am NOT including my social security number. I believe my name and account number identify me sufficiently.

 

Do I have any recourse?

This is the privacy terms for Juniper.  Where does it say they will close the acount when opting out?  What the heck? 

 

You may opt-out of: (1) information sharing with our affiliates and/or (2) marketing by our affiliates based on shared information, by visiting us online at the web address listed on the back of your card or by calling our Customer Service Center at 1-877-523-0478. For customers with prepaid card products, you may opt-out of information sharing with our affiliates by calling the Customer Service Center at 1-866-532-9634. Any such affiliate sharing opt-out does not apply to information that relates solely to our transactions or experiences with you or your account, but the affiliate marketing opt out may apply to the use of such information.

 

If you have previously notified us about your privacy preferences, it is not necessary to do so again unless you decide to change your preferences. Your preferences will remain in effect with respect to this Privacy Policy (as it may be amended) until you notify us otherwise in writing. If you have multiple Accounts, you will need to express your preference for each account separately. If you have a joint account, a request of any customer on the joint account to not share information or not use information for marketing will be applied to all account holders on that account.

 

If you access your Account online, select the ALERTS/PROFILE page where you can choose not to accept offers for (a) special opportunities from our selected partners and/or (b)special features and benefits related to your credit card account. You can also elect the method by which you will receive the offers: mail, email or telephone. You may also exercise or change your choices by calling our Customer Service Center at 1-877-523-0478. For customers with prepaid card products, you may choose not to accept these offers by calling the Customer Service Center at 1-866-532-9634. (We will, of course, contact you regarding your Account and related items regardless of your election.) I think you have recourse. You never asked to change the terms, you simply instructed them not to share your personal info with others.
