I am a bit confused regarding where I should Hipaa letter (with payment). I know it goes to the OC and not the CA however; I have received multiple addresses from the OC….I read the HIPAA process and it said that I should send it to the HIPAA compliance office of the OC.
The HIPAA compliance address they provided me is a PO BOX. I was able to locate the actual street address of the Emergency Department, which is also the billing address.
My question is since it has to be CMRR Should I send it to the PO BOX to the attention of Chief privacy officer or should I send it to the street address to the attention of the Chief privacy officer.
Before I answer your questions and you send off the HIPAA letter to the OC, have you already done the following?
1.) You must Opt Out of two things: Your Credit Reports and All Creditors. The first one ensures that the CRAs will not sell your personal data to anyone else (haha…no more data mining). The second one will prevent JDBs (and CAs) from buying and selling bogus collections.

Use this link to opt-out from all of your CURRENT creditors that you're in GOOD standing with. Do not attempt to opt-out with any CAs or current creditors that you're in BAD standing with (i.e. charge-offs, or currently late).
2.) Also, be sure to update your personal information with the CRA's before doing any credit repair.
3.) Send the pre-HIPAA dispute letter to the CRA ('s) CM (no RR, this is the only letter in the HIPAA process where you will not send it CMRRR) and wait up to 35 days for the results of the their investigation(s). Be sure to handwrite this letter and use personalized stationary. If your med collection is deleted, you're finished.

If you did send the pre-HIPAA medical dispute letter, did the CRAs verify your collection? Did the CA send you a complete and accurate validation?
I did opt out of the credit reports and credit card. My personal information is up to date.
Before I knew about the HIPAA process I disputed the charges and it came back verified. When I found out about this process I started from step one with the HIPAA dispute process. The CRA’s stated that they would not reinvestigate because the information had already been verified. I believe in another thread I was informed to treat this as a CA verification. I thought the next step would be to send the letter with payment to the OC.
If you send the CRAs the pre-HIPAA medical dispute letter and the CA does not send you a validation of the debt, you are supposed to send the CA a MEDICAL DV LETTER TO THE CA if the collection is unpaid, or you send the CA a ALTERNATIVE MED DV LETTER TO THE CA if the collection is paid.
Yes they are unpaid.
Just a little background, There are two collections …One for $129 and another for $75
Both are for an Emergency room visit from March 2006. They are with 2 different CA’S.
The $75 collection is only showing on my Experian report and the other is showing on all three.
After you receive the green card from the Med DV letter, mail this follow-up dispute letter along with copies of the Med DV letter and the green card to the CRA CMRRR.

You are providing new information to the CRAs, they should reinvestigate. If they refuse to, even with new information, I would file a complaint with the FTC for violations of the FCRA.
