There is your answer. They are absolutely correct--they CANNOT legally allow you to close it by yourself. By that same token, it also takes both of you to withdraw from the account too. Good lesson to know the type of account you are opening.

They probably wouldn't let you close it because you were negative. Once it's no longer negative they will let you close it.

ETA: If it was the type of joint trust ByrdMan was talking about, he would not have been able to make withdrawals in the first place.

He could if he used an ATM or debit card. Those restrictions are only for checks written.

I seemed to get the feeling that whether or not it is OD is irrelevant. If she were to bring in the $477, to bring it to $0, they can't close it if it is an "AND" account.

I don't know for sure, but I don't think it's an AND account, because both of us can write checks with out the others signature.  This should be interesting.  I'm leaving here in about 40 minutes and heading straight to the bank, so hopefully, it will be closed soon!  I will be sure to update you guys on Tuesday, to let you know what happened!

If you can both write checks without the others sig., then it should be an OR account.  You should be able to close it as soon as it is in positive numbers. If it is an AND account and they have been clearing checks that do not have your signature, then I would bring that point up as well.  You really don't need to let this one drop though, as you are responsible for any checks that he is bouncing around.

Okay, here's the scoop.  I went to the bank yesterday and instead of being $10 overdrawn, he is $89.  I am not going to pay that, however, the bank manager closed his ATM card and put a note on the account that he is not to have another one reissued to him, if he calls for one.
 
Secondly, since he owed that much, I am waiting for his paycheck next Friday to direct deposit.  This will take care of the final fees, and then I am gong to close it out on Friday (I am able to close it on my own, but I didn't want to pay that much in fees, when I didn't do the overdrafts).
 
He doesn't have any checks.  I had them all.  He only used is ATM card, so there is no way that he can get anymore money out of the account.
 
It was rather comical.  When I went to the bank yesterday, there was this long line for the walk-up ATM.  He was the last one in line.  I hid in my car and watched him go to the ATM machine, and obviously, he was not too happy about not being able to get any money!  So, it's a good thing I was able to put a stop on the card, or he would have taken even more money out and the overdraft fees would have just continued.
 
Thank you to all of you for your help in this.  It really made a difference!

I am glad things worked out like that.  He may make arrangements to get his check sent to him instead of the bank though, since he is unable to withdraw funds from the ATM.  You may be stuck with paying the $89.  IMO, it would be worth it just to be rid of all of this.
