Our vehicle was repossesed as well.  No Notice to Cure, or Notice of Acceleration was ever received and we even requested the gentleman repossessing the vehicle to vacate private property and he refused and threatened to call a police officer and have us arrested.  We retreated into the house and let him have the car. Would love to sue them for all they are worth.

They've reported a ton of things wrong on mine, and when my car was totaled when i lived in California. they waited months to tell me there was a balance even though gap had paid them and insurance. They came up with tons of rediciulous fees on top of that saying this and this when i had proof that the payoff they had gave me was met. now its stuck on my credit showing tons of paid late when it was maybe once or twice at max before I totaled it and they refuse to correct anything. now it just keeps reporting late cause they won't explain to me the 4k balance left when I know my payoff was met by insurance and gap.

I need people that live in CALIFORNIA that are dealing with the same Santander crap listed and complained about in this forum. All it takes is two parties to get the Attorney General to start an investigation into these complaints. Please contact me if your in CA. and would like to see justice served against Santander and Chrystler Capital for unfair credit reporting. It's our credit that these companies keep falsely reporting to. Where is FICO when it comes to the consumer??

I am in California. Got a loan in 2016 with Santander for a 2014 Nissan sentra, got behind because of medical issues, got caught, but got sick again, been paying every month regardless but my past due amount never goes down, my pay off option is now over 12,000 with a maturity date of 2022!!. They kept telling me my interest rate is 18%, and now they say it's always been 25%. Two weeks ago, my Nissan Sentra died while I was driving, car starts but turns off when I put it in drive or reverse. Had to have it towed to the dealership, was told I need a brand new transmission and that cost 4000 to replace because it's no longer under any kind of warranty. Hertz sold me a used rental car financed by Santander with 32k miles in 2016, because of the mileage most of the warranties expired within a few months. Did some research and found that Hertz and Santander have been selling this make and model even there where numerous complaints, pending investigations and lawsuits against Nissan and the 2014 Nissan CVT transmission needing to be completely replaced. I took it to AAMCO, they quoted me about $650 less and said they offer financing options to help pay for the repairs, but I did not qualify because Santander has reported inaccurate information on my credit report. I have no money to pay AAMCO, so I can't pick up my car, and I still have to make my payment because I'm afraid Santander will start calling me every day if I don't, I have to carpool to work, and at this point I really don't know what I'm going to. I'm so overwhelmed and frustrated with both Santander and Nissan, I'm probably going to have to turn in my car if I can't come up with the money to pay AAMCO within the next few days.

I know what you guys mean. They were included in my BK 13 repayment plan and once the secured portion of the plan was paid off, they started reporting late. I did not notice it until they had already posted 120 days late. I got that handled with a simple dispute with included in the bankruptcy and the entire account was deleted. Not exactly the same as what you guys are going through as I already had a court judgment to back mine up so I guess that is why they just deleted it or failed to reply to the dispute as a result. Either way, I'm thankful to be rid of these people

Have you all reported this to the Consumer Finance Protection Bureau? I had problems with Drivetime which I understand is owned by Santander and the CFPB helped me.  I contacted CFPB after reading this article.  I don't know how hard CFPB is working on the behalf of the consumer these days, but back then they fought the companies for the consumer.  It's probably worth a shot.

i would love to join this suit this company is affecting many of us. I havent been able to sleep at all wearing every month after month if am gonna be able to make the payment got car 3 years ago 2014 dodge charger they charge me $600 month for 3 years car was $23.000 gave them $10,000 cash when i got it still own $20.000 top of that the only thing thats lowering is intres still own $14,000. This is crazy stressful I really want everyone to get justace for overpaying. am interested in finding out more information on joining the suite against these criminals in the stat of dallas if you have any anformation available as i joined this site just to contact you for information. thx need as soon as possible as currently dealing with them now my self ....

I'm pretty sure I've read the same from others in Texas. That's what it takes. Just two people to start a class action lawsuit. Start with your State Attorney General. I haven't been able to contact anyone from California who is willing to join me in this severely overdue action against big-time subprime lenders like Santander.
