Bankruptcy Dispute - "Glitch"

This may be a unique situation, but I'm hoping others might have some advice.

 

I recently disputed a Chapter 7 Bankruptcy on my credit report for inaccurate reporting data. Within about a week of the report, I receive a response from Equifax stating, "We are pleased to let you know that the results of the dispute you recently filed with Equifax are complete." It goes on to list "The Results Of Our Investigation" and the item in dispute, along with "The results are: THIS ITEM HAS BEEN DELETED FROM THE CREDIT FILE."

 

Approximately a week later, I check my report, and it still exists on my report. I dial up Equifax to discuss this and after 45-minutes of hearing a representative talk in circles, SHE ASKS ME to speak to her supervisor. For another 30-minutes, I'm told it must be a glitch in their system, but that they can open a new dispute for me, and pending the results of another investigation, it could be removed.

 

Of course, I explain to the supervisor that I have a letter from her agency stating the above. I also explain that Equifax has acknowledged the incorrect reporting in writing, vowed to delete it, but didn't. I said, "wouldn't that violate the FCRA in some way?" She very basically told me there is nothing else she can do for me. I feel like I'm at a stalemate - I have a CRA stating that their investigation found the data on my report to be incorrect, that they'd remove it, it still exists, and I can't get anyone competent enough to fix their "glitch."

 

Any sage words of wisdom?

It kind of sounds like the BK was reinserted. Which frequently happens with valid negative information that is removed via dispute. Just because a small part of the reporting is wrong doesn't mean that the account has to be deleted. 

Is the inaccurate information that you originally disputed still present or was it corrected?

What are you actually disputing? If it is something incorrectly reporting they will correct it  but the BK will remain as it should since that is accurate.

Having disputed many wrongly reported accounts on my 3 reports that were IIB, I can speak a little to your issue. But there are questions. 

First, what was the nature of your dispute? You say you were disputing "inaccurately reporting data" but you seem to be implying that it is the BK7 itself that is the mistake... ?

- if you did not have a BK7, then clearly it is an error they must address immediately

- if you did have a BK7, but they are misreporting it, then can you explain a little more how they are misreporting it? For example, it is often the case that an account is reporting the wrong amount or the wrong dates etc. Those must be fixed in a dispute if they are correct. 

so are you disputing the existence of the BK7 in the public records part of your credit report OR an account(s) that is misreported as IIB or other info that should not be? 
 
I think for folks to help you might need to clarify the nature of your dispute that EQ agreed to remove. 

also sometimes disputes are removed within a month of the results (for me I think that happened for TU; however Experian updated something immediately for me after a phone call!) so you might have to wait.

I paid a credit repair company to dispute my ch 7 at about 5 and half year after discharge. Transunion removed, then came back, then removed again. Now transunion and equifax have the chapter 7 removed for about a year and half. Still reports on experian.

 

I dont know what they disputed, but its possible to get it removed successfully.

 

I'm just over 7 years from my discharge.

According to the Fair Credit Reporting Act (FCRA), a Chapter 7 bankruptcy can remain on your credit history for up to 10 years from the filing date. A bankruptcy cannot be removed simply because you do not want it there. So this company is taking your $ for something that cant be done. The CRA's get a BK alert from third parties, not the courts. Once the CRA's computers do a sweep again. It will pop up once more. If it was that easy. We'd all be doing it. And ignore the you tube junk also.
