I'm not sure if it the last few posters know...or if it even makes a difference as the information is still good good for someone, even if not the OP....but the OP filed for BK already. He started another thread where he told us this.  I say"he"...I'm assuming it's a he...sometimes it's hard for me to tell on here without more information.

Yes at this point. To stop it would require some less than desirable process.... Still doesnt help these people having me second guessing my decision lol Smiley Sad yes I am a he BTW.

Your OP says you are about to file, but your other thread says you already filed. Which is it? The answer does matter.

 

If you have already filed with the court then you can ignore everything I have said because you cannot unfile a BK. Even a dismissed BK with stay on your credit report with very few and limited exceptions. There are some cases where a petitioner has been able to remove dismissed BK cases from their credit report and had the court  either nullify the proceedings by a notation/motion or expunge them altogether, but most of those cases involve fraduluent activity, counsel filing without consent, or satisying creditors after the case was discharged. It's so difficult to unfile, that if you have filed, you would probably be better off going forward. I am trying to find a way to nullify my filing right now, but most of my baddies come off later this year, so it's worth it to pay a lawyer to do that and I found a case that can be argued in my favor based on somewhat similar circumstances.

 

Even with the advice I have given a BK still may be the wise course of action, but only you can know based on when your DOFD was*, how long you will have to wait for a clean report, and what you are willing to live with.

 

*Sometimes collection agencies will put a later DOFD especially if they bought the debt 2 years later, so you should make sure all of your accounts show the right DOFD and that should be 30 days past whenever your hospital admission was.

Well. I think? I filled paperwork out. Did some online courses. Did a signing. And now I'm waiting

Did you file the paperwork with the court though? Or have an attorney file in the court for you?

 

If so, then you have filed and you are better off going through with it.
