IMHO, the biggest liability TC is going to face is how their web site advertised unlimited pulls. One can split hairs about whether TC is technically a CRA or not, but the unlimited access element in their advertising is clear and undeniable.
There is a codicil in the TOS for TC saying the service may not always be available, but I strongly suspect a judge would interpret that to cover network outages, IT issues, or overall force majeure, not a willful discontinuation of service...

What I find amusing was TC's response to another MyFICO forum citizen who challenged the service termination, which was in part:
"After a thorough investigation, it is our conclusion that your account should not be reinstated due to an access pattern which indicates potential fraud or a deliberate intent to tamper with the credit scoring system. Your access, billing and all account related email alerts have now permanently been terminated as a result."
TC is going to have loads of fun trying to prove in court that its subscribers had fraudulent intent in doing daily credit pulls. After all, one of the major selling points of the daily pull service was protection against the allegedly omnipresent, terrible threat of identity theft. Frequent pulls were put out there as a way a consumer could feel confident and protected, being able to quickly spot and react to identity theft.

I wonder if TU Execs secretly lurk on these message boards. In a way I hope they do--and I hope the news gets out that they have screwed over so many customers.
This is true, but if you look at what happened to Juniper and what is happening at TC, I think these small ponds have enough savvy people in them to have an effectNoah_Bodie wrote:MyFico Forums is but a backyard pond. CIC and CB are a couple of larger yet still very, very small ponds of consumers.

Probably 1 in 10 TC users ever update their reports ever. Other 90% get the auto-update every 30 days. Some good news. I can't login to TC, so perhaps TU expelled me. Yay me!
