Unbelievable---Somebody please explain what this means

Just printed off Case summary for judgment with American General Finance.  They tried to serve me back 09/01 at my job, never came to my house to serve me, so I never saw any paperwork. Company I worked for the name was spelled wrong and that company went out of business in August, 2001 and we all lost our jobs.  Anyway the paperwork further states  "Citation Defendant Dismissed"  this was on January 8, 2002.  What does this mean and could I mail a copy of this paperwork to TU to get them to remove the judgment or not?  I am the defendant, right?

Try calling the court (Clerk's Office) and asking them exactly what "Citation Defendant Dismissed" means.  Then let us know and maybe we can suggest what to do.

I did that this morning.  The person on the phone didn't know how to explain it.  She said it was dismissed because they could not serve me.  ?

Re: Unbelievable---Somebody please explain what this means

Just called back. I was told that this was an order that they were trying to serve to my employer that was dismissed because they couldn't serve them.  Again, the company was closed at the time they tried to serve.  The account since was put into the BK7 and discharged.

Re: Unbelievable---Somebody please explain what this means

Right.  It sounds like they attempted to serve you notice, but because they could not, they just went ahead and got a summary judgment after an attempt or two.  I would need a little more information to accurately attempt to answer you question.  When you say, "printed off a case summary for judgment" what exactly do you mean?  Printed it off from where.  How is it listing on with the CRA's.  I don't think that sending that to the CRA's will do anything.  It sounds like it is a judgment and you need to make sure that is is satisfied with the courts, first.  I am not an attorney, however, I am familiar with the terminology by virtue of my line of work and I can try to help you decipher the information.

Re: Unbelievable---Somebody please explain what this means

I went on the circuit court of cook county's website, put in my case number and found the judgment, printed a copy of it.  Just a few weeks ago this was showing as satisfied/paid and then all of a sudden it was showing as dismissed on Ex and Eq.

Re: Unbelievable---Somebody please explain what this means

OK.  The court papers show that the judgment is in effect, not satisfied.  I have no idea why two months ago, this would read paid/satisfied.  However, because you filed BK and included the judgment in the BK, this should be dismissed by the court and considered satsified.  I would send a copy of your BK paperwork to the court, showing that this judgment was satisfied by the terms of the BK.  Once the court satisfies the judgment, you should be able to get it removed from the credit reports.  I assume that the BK was discharged and not dismissed, correct?  I'll change my answers if the BK was dismissed.  Hope this helps, and remember that I am not an attorney.

Re: Unbelievable---Somebody please explain what this means

OK, I thought so.  Then I would send a copy of the discharge papers to the court to have them record the judgment as settled.  Once that happens, then dispute with the CRA's.  It could take some time, though.  See if the court will let you fax the information over so that they can record the judgment as satisfied and see if they will send an automatic update to the CRA's to remove the judgment notation...
